RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-04472 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected as follows: Item 7a, Place of Entry into Active Duty, be changed from Albuquerque, NM to Houston, TX; Item 12a, Date Entered Active Duty This Period, be changed from “1977 April 11” to “1969 May 05.” APPLICANT CONTENDS THAT: He entered active duty in Houston, TX on 5 May 1969. In support of his request the applicant provides copies of his DD Forms 214, Certificate of Release or Discharge from Active Duty and AF Form 1613, Statement of Service. The applicant believes that the Board should find it in the interest of justice to consider his untimely application because he only recently discovered the errors on his DD Form 214, Certificate of Release or Discharge from Active Duty, while registering with the Department of Veterans Affairs. His complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant enlisted in the Regular Air Force on 5 May 1969. He was retired on 31 May 1992 after serving 23 years and 27 days of active duty. The applicant’s initial DD Form 4, Enlistment/Reenlistment Document – Armed Forces of the United States, signed on 30 April 1969 reflects the following: Item 6, Date of Entry, reflects “05/05/69.” Item 9, Name & Location of Activity Effecting Enlistment/ Reenlistment/Induction reflects “AAFES Houston, TX LCMM 43.” Item 15, Accepted At, reflects “AAFES, Houston, TX LCMM 43.” The applicant was issued three DD Forms 214 during his service. They are dated as follows and do not reflect a break in service: 11 April 1977 - 31 May 1992 5 May 1973 - 10 May 1977 5 May 1969 - 4 May 1973 THE AIR FORCE EVALUATION: DPSIPE recommends denial of changing the applicant place of entry. The DD Form 4 is the source document for place of entry. The place of entry is the location identified by the individual upon entering the service, not a location where the individual is later assigned or a location selected for convenience; a correction must be fully justified. Domicile or legal residence may change, but the place of entry will not. AFPC Enlisted Accessions Branch confirmed that his initial place of entry onto active duty was Clovis, New Mexico on 5 May 1969. The complete DPSIPE evaluation is at Exhibit C. AFPC/DPSIPV recommends denial of the applicant’s request to change his “Date Entered Active Duty This Period.” He was issued three DD Forms 214 during his service. A period of time already captured on a previous DD Form 214 cannot be combined with a later DD Form 214 as though they are only one period. It is a combination of all three DD Forms 214 that reflects the full service time. The applicant’s final DD Form 214, item 12c “Net Active Service this Period” and 12d “Total Prior Active Service” combined correctly reflects his total active duty service of 23 years and 27 days. APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 21 March 2014, copies of the Air Force evaluations were forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit E). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant changing the “Date Entered Active Duty This Period.” We took notice of the applicant’s complete submission in judging the merits of this case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. In the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this portion of his application. 4. Notwithstanding the above, sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant partial relief. After a thorough review of the evidence of record, we find the applicant’s DD Form 4, which is the source document for “place of entry,” reflects that he did in fact enter active duty on 5 May 1969 in Houston, TX. Therefore, we find the evidence sufficient to change his place of entry to reflect Houston, TX rather than Clovis, NM. Accordingly, we recommend his records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that his DD Form 214, Certificate of Release or Discharge from Active Duty, Item 7a, Place of Entry into Active Duty, be amended to reflect Houston, TX.
