RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-05860 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His record be corrected to reflect a year of satisfactory service for retirement year ending (RYE) 28 May 2012. APPLICANT CONTENDS THAT: Due to circumstances beyond his control he lost his billet with USSTRATCOM/J7. However, he was still able to obtain 13 points through Military Personnel Appropriation (MPA) orders which should warrant an exception for RYE 28 May 2012. The applicant's complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Air Force Reserves in the grade of major. The remaining relevant facts pertaining to this application, extracted from the applicant’s military personnel records, are contained in the letter prepared by the appropriate office of the Air Force at Exhibit B. AIR FORCE EVALUATION: ARPC/DPTS recommends approval. DPTS states it appears that USSTRATCOM's decision to discontinue the applicant’s position prevented him from earning sufficient participation points to complete a qualifying year of service for RYE 28 May 2012. The circumstances that prevented the applicant from obtaining points were that his overage contract was discontinued, FY12 annual training was denied due to lack of funding and late acquisition of funds did not allow him to participate in IDTs for the greater part of FY12 and RYE 28 May 2012. The applicant submitted three letters of justification in support of his appeal, which states that he made a genuine effort to participate for points; the Command Historian, also recognized the applicant’s effort to complete participation; and the Director of Joint Exercises and Training, verified the applicant’s overage status was due to internal re-organization and was no fault of the applicant. If the Board agrees with our recommendation, the records should be corrected to show the member was awarded 22 additional non- paid IDTs for RYE 28 May 2012. This will give the member a total of 50 total retirement points and a satisfactory service year. The complete AFPC/DPTS evaluation, with attachments, is at Exhibit B. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 15 September 2014, a copy of the Air Force evaluation was forwarded to the applicant for review and response within 30 days (Exhibit C). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice warranting corrective action. In this respect, the Air Force office of primary responsibility (OPR) has indicated the decision to discontinue the applicant’s position prevented him from earning sufficient participation points to complete a qualifying year of service for RYE 28 May 2012. Therefore, in order to preclude the possibility of an injustice to the applicant, the Board recommends the records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that he was credited with an additional 22 non-paid inactive duty training points during the retirement/retention year ending 28 May 2012, resulting in 50 total points; and that the period ending 28 May 2012 is a year of satisfactory Federal service.
