RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-00318 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records be considered for promotion to the grade of Brigadier General by a Special Selection Board (SSB) for his primary zone O-7 Central Selection Board. APPLICANT CONTENDS THAT: When events led him to believe that his records had not been considered by the central selection board, he wrote a letter to the Secretary of the Air Force. He felt he was competitive with many in the cohort who were selected. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 6 June 1962 and was released from active duty for the purpose of retirement with an honorable characterization of service on 30 June 1992. He was credited with 30 years and 25 days of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AF/DPO recommends denial indicating there is no evidence of an error or an injustice. DPO states that at the time the applicant is requesting supplemental consideration, promotion eligibility was considered in three zones: Zone 1: 27 years of service or more; Zone II: 24-26 years of service; and Zone III: 23 years of service or less. Historically, Zone II is the primary zone for consideration, or the group with the highest selection rate with 24 years of service. A review of the CY85-CY9l Brigadier General Promotion Selection Boards indicates the applicant was considered for promotion to brigadier general in the CY85 Brigadier General Selection Board but was not selected for promotion. The CY85 Brigadier General Selection Board considered colonels on active duty with a Date of Rank of 31 December 1983 or earlier. The applicant’s record was reviewed by an Initial Screening Board, a Central Screening Board and the Final Selection Board. He was considered in Zone II with 24 years of service based on his year group of 1962. The goal for this particular board was to promote 10% from Zone I, 65% from Zone II, and 25% from Zone III. A review of promotion records indicates the applicant was considered for promotion at 24 years of service or against what would have been the primary zone for his year group, 1986. Therefore, there is no basis for supplemental consideration. A complete copy of the AF/DPO evaluation, with attachments, is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 15 September 2014 for review and comment within 30 days (Exhibit D). To date, a response has not been received by this office. FINDINGS AND CONCLUSIONS OF THE BOARD: After careful consideration of applicant’s request and the evidence of record, we find the application untimely. The applicant did not file within three years after the alleged error or injustice was discovered as required by Title 10, United States Code, Section 1552 and Air Force Instruction (AFI) 36-2603, Air Force Board for Correction of Military Records. The applicant has not shown a plausible reason for the delay in filing, and we are not persuaded that the record raises issues of error or injustice, which require resolution on the merits since, the evidence established indicates that a review of the CY85-CY91 Brigadier General Promotion Selection Boards shows that, contrary to his contention, the applicant’s record was considered for promotion to brigadier general in the CY85 Brigadier General Selection Board but he was not selected for promotion. Thus, in view of the above, we cannot conclude it would be in the interest of justice to excuse applicant’s failure to file in a timely manner. DECISION OF THE BOARD: The application was not timely filed and it would not be in the interest of justice to waive the untimeliness. It is the decision of the Board, therefore, to reject the application as untimely.
