RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-00877 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be amended to reflect the Air and Space Campaign Medal (ASCM). APPLICANT CONTENDS THAT: He deployed in support of Operation ALLIED FORCE and should have been awarded the ASCM. He further contends another member he deployed with received the ASCM for the same period of service. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant commenced his service in the Regular Air Force on 14 Mar 83. According to documentation provided by the applicant, his name is listed on group special mission travel orders, in support of Operation ALLIED FORCE, from to an undisclosed location and return to with a proceed date of on/about , for a period of 179 days. On 30 Nov 03, the applicant was relieved from active duty and retired, effective 1 Dec 03, and was credited with 20 years, 8 months, and 17 days of active service; which included one year, one month, and three days of foreign service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The ASCM may be awarded to member of the United States Air Force who, after 24 Mar 99, supported a significant United States military operation designated by the Chief of Staff of the Air Force as qualifying of the ASCM. Members who provided direct support for 30 consecutive or 60 nonconsecutive days to one of these operations at home station or from outside of the geographic area of combat qualify for award of the ASCM. While information from the Defense Finance and Accounting Service (DFAS) indicates the applicant deployed to from through , and his enlisted performance report for the period indicates he deployed in support of Operation ALLIED FORCE, because this award was authorized for this operation from 24 Mar 99 through 10 Jun 99, only 16 days of the deployment fell within the qualifying period of the award. Therefore, he does not meet the criteria for the award. To grant relief would be contrary to the criteria established by DoDM 1348.33, Secretary of the Air Force, Chief of Staff, and/or the War Department. A complete copy of the AFPC/DPSID evaluation is at Exhibit C APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 28 Jul 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting correction of the applicant’s records to reflect his entitlement to the ASCM. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in view of the above, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
