RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01199 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her spouse, a deceased former Air Force member, be awarded the Air Force Outstanding Unit Award with Valor and one Bronze Oak Leaf Cluster (AFOUA w/V w/1BOLC). APPLICANT CONTENDS THAT: The former-member was assigned to the 432nd Tactical Reconnaissance Wing (432TRW) when that unit was awarded the Air Force Outstanding Unit Award with Valor, but he was not aware of the award. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 24 Oct 68. On 2 Sep 72, the former member received an AF Form 910, TSGT, SSGT AND SGT PERFORMANCE REPORT, while assigned to the 432nd Field Maintenance Squadron (FMS), Udorn RTAFB, Thailand, during the period 1 Sep 71 through 31 Aug 72. On 20 Oct 72, the former member was furnished an honorable discharge, and was credited with 3 years, 11 months, and 27 days of total active service. According to the documentation submitted by the applicant, the former-member passed away on 19 Jun 12. On 24 Nov 14, AFPC/DPSIDR directed the former member’s DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to add award of the Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P), and to change the “VSM” to read “Vietnam Service Medal with three Bronze Oak Leaf Clusters (VSM w/3BSS).” The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The AFOUA is awarded by the Secretary of the Air Force to numbered units that have distinguished themselves by exceptionally meritorious service or outstanding achievement that clearly sets the unit above and apart from similar units. This service includes: performance of exceptionally meritorious service, accomplishment of a specific outstanding achievement of national or international significance, combat operations against an armed enemy of the United States, or military operations involving conflict with or exposure to hostile actions by an opposing foreign force. A bronze valor device may be worn on the service ribbon when the award of the AFOUA is made to a unit for combat or direct combat. A thorough review of the former member’s official military record failed to verify any documentation supporting award of the AFOUA w/V w/1BOLC, nor did the applicant provide any such documentation. Further, there is no documentation in the former member’s record to verify any unit he was assigned to was awarded the AFOUA w/V. A complete copy of the AFPC/DPSID evaluation, with attachment, is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 23 Feb 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. FINDINGS AND CONCLUSIONS OF THE BOARD: After careful consideration of applicant’s request and the available evidence of record, we find the application untimely. Applicant did not file within three years after the alleged error or injustice was discovered as required by Title 10, United States Code, Section 1552 and Air Force Instruction 36-2603. Applicant has not shown a plausible reason for the delay in filing, and we are not persuaded that the record raises issues of error or injustice which require resolution on the merits. Thus, we cannot conclude it would be in the interest of justice to excuse the applicant’s failure to file in a timely manner. THE BOARD DETERMINES THAT: The application was not timely filed and it would not be in the interest of justice to waive the untimeliness. It is the decision of the Board, therefore, to reject the application as untimely.
