RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01220 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His records be corrected to reflect that he was promoted to the grade of Airman First Class (A1C, E-3), effective 6 Apr 13 instead of 6 Oct 13. ________________________________________________________________ APPLICANT CONTENDS THAT: Air National Guard Instruction (ANGI) 36-2502, Promotion of Airmen, Table 2.1, Rule 2, states that an E-2 should promote to E-3 after six months of Time in Grade (TIG) in the ANG. He served longer than six months without being promoted. According to his TIG and Time in Service (TIS), he should have been promoted to the grade of A1C on 6 Apr 13. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: According to the applicant’s DD Form 4/1, Enlistment/Reenlistment Document Armed Forces of the United States, on 1 Feb 12, the applicant enlisted in the ANG in the grade of Airman Basic (AB, E-1) for a period of eight years. According to an AF Form 2096, Classification/On-The-Job Training Action, dated 6 Oct 13, the applicant was promoted to the grade of A1C. ________________________________________________________________ AIR FORCE EVALUATION: NGB/A1PP recommends denial, indicating the applicant did not receive a promotion recommendation until 6 Oct 13. The six months referred to in ANGI 36-2502, Table 2.1, reflect TIG requirements to be eligible for promotion and does not require automatic promotion upon meeting said milestones. ANGI 36-2502, paragraph 1.4 states, “The fact a member meets each of the eligibility criteria outlined in this instruction does not automatically guarantee promotion to the next higher grade. Meeting minimum eligibility criteria only indicates that a member can be considered eligible for promotion. Promotion is not a reward for past performance, but recognition of the member’s potential to successfully serve in the higher grade. Prior to promotion to any grade, the immediate commander must first recommend the airman.” The applicant’s commander approved his promotion to the grade of E-3 with an effective date and date of rank of 6 Oct 13. Without the commander’s endorsement, the applicant would not have been allowed to be promoted from E-2 to E-3. The complete A1PP evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 13 Jun 14 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice.
