RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01347 COUNSEL: HEARING DESIRED: YES APPLICANT REQUESTS THAT: He be paid the Dental Officer Multi-Year Retention Bonus (DOMRB) based on his four-year Active Duty Service Commitment (ADSC) effective 23 December 2012. APPLICANT CONTENDS THAT: Due to an error in his records associated with his accession as a dental officer, he has not been paid the DOMRB to which he is entitled. Specifically, instead of paying him a DOMRB amount based on his four-year ADSC, the Air Force records mistakenly reflected his ADSC as being less than four-years and has paid him a lesser DOMRB amount based on that error. His records have now been corrected; however he has not been paid the DOMRB at the contracted four-year rate. In support of his request, the applicant provides a personal statement, copies of his AFRS IMT 1430, Statement of Understanding - Applicant for Extended Active Duty - USAF Health Professionals; AF IMT 766, Extended Active Duty Order; DOMRB Contract, electronic communiqués, memorandums and various other documents associated with his request. The applicant's complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: According to AFRS IMT 1430 dated 27 September 2012, the applicant signed and accepted the Statement of Understanding, which required him to serve on extended active duty for a period of four years. According to AF IMT 766, the applicant entered active duty on 23 December 2012. On 2 January 2013, the applicant signed a contract for Multi- Year Incentive Special Pay (MISP)/DOMRB for a period of four- years. AIR FORCE EVALUATION: AFPC/DPNAF recommends approval. Due to an administrative error on the part of the Air Force, the applicant’s MISP/DOMRB contract was not properly processed at the four-year rate. In November 2013, the applicant’s record was corrected; however his contract had already been adjusted and processed as a two-year contract, therefore, retroactive processing of a new four-year contract would require Board action. APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 1 August 2014, a copy of the Air Force evaluation was forwarded to the applicant’s counsel for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit C). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting relief. Having carefully reviewed this application, we agree with the recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. Therefore, we recommend the applicant's records be corrected as set forth below. 4. The applicant's case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to the Board's understanding of the issues involved. Therefore, the request for a hearing is not favorably considered. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT is corrected to show that competent authority approved his request for a Multi-Year Incentive Special Pay Dental Officer Multi-Year Retention Bonus for a period of four-years effective 23 December 2012.
