RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01512 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to add the Kosovo Campaign Medal (KCM). APPLICANT CONTENDS THAT: He recently discovered that there is a Kosovo Medal. He would like to verify whether or not his service qualifies him for the award. In support of his request, the applicant provides a copy of an Officer Performance Report (OPR), while assigned to the 26th Intelligence Group, Ramstein Air Base, Germany which documents that he directed group operations during the Kosovo air war, improved force protection and future unit operation benchmark. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 25 Aug 79. On 30 Sep 01, the applicant retired with an Honorable discharge, and was credited with 25 years and 4 months of active service. The applicant’s DD Form 214 reflects award of the following Air Force Medals and/or Ribbons: - Defense Meritorious Service Medal with one device - Meritorious Service Medal with two devices - Air Force Commendation Medal with one device - Joint Service Achievement Medal with one device - Air Force Overseas Ribbon – Long Tour with two devices - Air Force Overseas Ribbon – Short Tour - National Defense Service Medal with one device - Air Force Longevity Service Award with five devices - Army Good Conduct Medal - Air Force Training Ribbon - Armed Forces Service Ribbon - NATO Medal - Air Force Outstanding United Award with two devices - Joint Meritorious Unit Award with one device - Air Force Organizational Excellence Award The applicant also has a DD Form 215, Correction to DD Form 214, Certificate of Release or Discharge from Active Duty, which reflects award of the following Air Force Medals and/or Ribbons: - Korean Defense Service Medal - Global War on Terrorism Service Medal The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The KCM was established to recognize military service performed in Kosovo from 24 Mar 99 to a date to be determined. Two campaigns were subsequently established that encompass all United States Military operations in Kosovo. They are the Kosovo Air Campaign and Kosovo Defense Campaign. Individuals authorized to the KCM must have participated in or served in direct support of Kosovo operations within the Kosovo Air Campaign area of eligibility or Kosovo Defense Campaign area of eligibility. For the Kosovo Air Campaign (24 Mar 99 through 10 Jun 99): the total land area and air space of Serbia (including Kosovo), Montenegro, Albania, Macedonia, Bosnia, Croatia, Hungary, Romania, Greece, Bulgaria, Italy, and Slovenia; and the waters and air space of the Adriatic and Ionian Sea north of the 39th North latitude. For the Kosovo Defense Campaign (11 Jun 99 through a date to be determined); the total land area and air space of Serbia (including Kosovo), Montenegro, Albania, Macedonia and the waters and air space of the Adriatic seas within 12 nautical miles of the Montenegro, Albania, and Croatia coastlines south of 42 degrees and 52 minutes North latitude. Service member must have been permanently assigned, attached, or detailed to a unit that participated in or was engaged in direct support of designated operations for 30 consecutive days in the area of eligibility or for 60 non-consecutive days provided this support involved entering the area of eligibility or meet one or more of the following criteria: was engaged in actual combat, or duty that is equally hazardous as combat, with armed opposition, regardless of time in the operation; while participating in a designated operations, regardless of time, was killed, wounded, or injured requiring medical evaluation from the operation. Service member participating as regularly assigned aircrew members accrue one day of eligibility for each day they fly into, out of, within, or over the area of eligibility in direct support of the military operations. After the thorough review of the applicant’s official military records, they were unable to verify award of the KCM. Although the applicant’s OPR states that he directed group operations during Kosovo air war; it does not state he deployed to the area of eligibility for award of the KCM. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 30 Sep 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
