RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01611 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: The following awards be added to his DD Form 214, Certificate of Release or Discharge from Active Duty: Presidential Unit Citation (PUC); Bronze Star Medal (BSM) and the Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P) (Will be administratively corrected). APPLICANT CONTENDS THAT: The awards were left off of his DD Form 214. He needs the BSM in order to get an auto tag in Texas. He was also told when he left Vietnam his unit received the PUC and RVNGC w/P. In support of his request, the applicant provides a copy of his DD Form 214, the BSM citation and the award. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 28 Feb 67, the applicant enlisted in the Regular Air Force. On 12 May 75, the applicant received an honorable discharge. He was credited with 4 years, 2 months and 14 days of active service. AIR FORCE EVALUATION: AFPC/DPSIP recommends disapproval for award of the PUC. DPSIP was unable to verify the applicant served with a unit that was awarded the PUC. DPSIP determined the Air Force Medals and/or Ribbons below should have been awarded for the applicant’s service from 28 Feb 67 to 27 Feb 71 and were not reflected in his records. Upon final Board decision, administrative correction of the applicant’s official military personnel record will be completed by AFPC/DPSOR: Bronze Star Medal (BSM); Air Force Outstanding Unit Award with Valor and one Bronze Oak Leaf Cluster (AFOUA w/V & 1BOLC); Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P). The complete DPSIP evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 26 Sep 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice to warrant award of the PUC. Therefore, we agree with the opinion and recommendation of the Air Force Office of Primary Responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. Aside from the administrative corrections noted above, we find no basis to grant the additional relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of a material error or injustice; that the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
