RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01656 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His two non-selections for promotion to the grade of major while assigned to the Individual Ready Reserve (IRR) be removed. APPLICANT CONTENDS THAT: He was unaware that he was being considered for promotion while assigned to the IRR. He loved serving his country while in the Regular Air Force and now he has an opportunity to serve in the Air National Guard (ANG). In support of his request, the applicant provides a personal statement, copies of a letter of support from an ANG commander; and various other documents associated with his request. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 27 September 2001, the applicant entered active duty. On 30 September 2011, the applicant was honorably discharged from the Air Force. His narrative reason for separation is “Non-Selection, Permanent Promotion.” He served 10 years and 4 days of active service. According to Reserve Order PC-00248 dated 28 November 2011, the applicant was assigned to the Nonobligated Nonparticipating Ready Personnel Section (NNRPS) effective 1 November 2011. On 13 March 2013, the applicant was notified that he was not recommended for promotion by the Reserve of the Air Force Selection Board and would be retained as a member of the Reserve until 30 September 2014, the date of expiration of his Special Separation Benefit Program contract. ? According to Reserve Order DA-00256 dated 17 December 2013, the applicant was again assigned to the NNRPS effective 26 November 2013. THE AIR FORCE EVALUATION: ARPC/PB recommends denial. The applicant has not presented any evidence to prove the boards acted contrary to law or regulation, or that his record contained any errors when considered by the boards. The applicant was considered, but not selected, by the calendar year 2012 and 2013 Nonparticipating Reserve Major Promotion Selection Boards. When considered by these boards, the applicant was assigned to the NNRPS. The promotion quota for Nonparticipating Reserve Promotion Boards is one (1). Although members in this Reserve section are not in a participating status, in accordance with Title 10 USC, § 14301, all officers on the Reserve Active Status List must be considered for promotion when eligible. Each nonparticipating candidate is notified and provided an Officer Pre-selection Brief by mail approximately four months prior to each promotion board. A board convening notice is also posted to the MyPers website announcing each board. The complete PB evaluation is at Exhibit C. APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 27 June 2014, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
