RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01669 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records be corrected to reflect that he was on Medical Continuation (MEDCON) orders from 19 June 2013 to 27 June 2013 with full pay and points. APPLICANT CONTENDS THAT: There was a delay in the initial MEDCON order application process, which resulted in a gap between the 30 day extension on the original order and his approved MEDCON orders. In support of his request, the applicant provides copies of his MEDCON application package. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: According to Special Order R-T000274 dated 28 May 2013, the applicant was on active duty orders from 28 Feb 2013 - 18 Jun 2013. According to an AF Form 348, Line of Duty determination, dated 1 June 2013, the applicant, a traditional guardsman on title 10 orders in leave status was participating in a sanctioned motorcycle race in Concord, NH; he lost control of his motorcycle and crashed. In an email to the National Guard Bureau Surgeon General dated 12 June 2013, the medical group superintendent requested the applicant’s MEDCON orders scheduled to end on 18 June 2013, be continued due to the motorcycle accident. According to DD Form 214, Certificate of Release or Discharge from Active Duty, the applicant was on active duty from 28 June 2013 through 26 March 2014. AIR FORCE EVALUATION: AFPC/DPFA recommends approval. There is evidence the applicant’s MEDCON request was delayed due to administrative processing. The applicant was approved for Pre-MEDCON from 21 May 2013 - 18 June 2013, which afforded time for the MEDCON request package to be coordinated between the unit and NGB/SG. NGB/SG submitted the MEDCON request package to the legacy MEDCON management cell on 14 June 2013, prior to the end date of the Pre-MEDCON orders. However, there is no explanation why it took 9 days to process the request. Therefore, the applicant should be approved for MEDCON from 19 June 2013 to 27 June 2013. APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 10 October 2014, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit C). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. Having carefully reviewed this application, we agree with the recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. Therefore, we recommend the applicant's records be corrected as set forth below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that he was not released from active duty on 18 June 2013, but on that date he continued on active duty for the purpose of medical evaluation through 26 March 2014, in accordance with Title 10, United States Code § 12301 (h), at which time he was released from active duty.
