RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-02618 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His Separation Program Designator (SPD) of JGH, which denotes "Involuntary discharge, minimally productive/limited potential airman,” be changed. APPLICANT CONTENDS THAT: The SPD code and corresponding reason for separation is disparaging, ambiguous and leaves an unfavorable impression of his military service. The Board should find it in the interest of justice to consider his untimely application because he was very proud to serve his country; however, due to personal problems he had to “cut short his service.” In support of his request, the applicant provides a copy of his DD Form 214, Report of Separation from Active Duty. The applicant’s complete submission, with attachment, is at Exhibit A. STATEMENT OF FACTS: On 24 August 1973, the applicant enlisted in the Regular Air Force. On 6 September 1974, the applicant’s commander notified him that he was recommending he be discharged under the provisions of AFM 39-10, Separation Upon Expiration of Term of Service, for Convenience of Government, Minority, Dependency, and Hardship. The specific reasons for his action were that the applicant failed to maintain an acceptable standard of behavior, personal dress, appearance, and initiative. The applicant was counseled on numerous occasions; however, counseling had gone unheeded and further efforts to rehabilitate him were not considered in the best interest of the Air Force. On 6 September 1974, the applicant acknowledged receipt of the discharge notification and that legal counsel was made available to him. He did not request retention in the Air Force. In an undated letter, the discharge authority approved an honorable discharge. On 13 September 1974, the applicant was honorably discharged from the Air Force. His SPD code is “JGH” and his reason for separation is “Involuntary discharge, minimally productive/ limited potential airman.” He served on active duty for 1 year and 20 days. AIR FORCE EVALUATION: AFPC/DPSOR recommends denial. The applicant has not submitted a timely application. It has been almost 40 years since the applicant separated from the Air Force and he has not provided any evidence of an error or injustice regarding the processing of his discharge. Based on the documentation on file in the master personnel records, the discharge was consistent with the procedural and substantive requirements of the discharge regulation and within the discretion of the discharge authority. APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 8 September 2014, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). FINDINGS AND CONCLUSIONS OF THE BOARD: After careful consideration of applicant’s request and the available evidence of record, we find the application untimely. The applicant did not file within three years after the alleged error or injustice was discovered as required by Title 10, United States Code, § 1552, Correction of Military Records and AFI 36-2603, Air Force Board for Correction of Military Records. Furthermore, the applicant has not shown a plausible reason for the delay in filing, and we are not persuaded that the record raises issues of error or injustice which require resolution on the merits. Thus, we cannot conclude it would be in the interest of justice to excuse the applicant’s failure to file in a timely manner. THE BOARD DETERMINES THAT: The application was not timely filed and it would not be in the interest of justice to waive the untimeliness. It is the decision of the Board, therefore, to reject the application as untimely.
