RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-02633 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be awarded the Korean Defense Service Medal (KDSM) and issued a DD Form 215, Correction to the DD Form 214, Certificate of Release or Discharge from Active Duty, to reflect the KDSM. APPLICANT CONTENDS THAT: He served on temporary duty with the 8th Tactical Fighter Wing, Osan, South Korea on several occasions between the years of 1961 and 1963. This service qualifies him for the award of the KDSM. The applicant’s complete submission is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 16 Mar 61. On 14 Mar 69, the applicant was furnished an Honorable discharge, and was credited with 11 years, 7 months, and 22 days of active service. The applicant’s DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, reflects the following Air Force Medals and/or Ribbons: - Air Force Good Conduct Medal with one Oak Leaf Cluster - Air Force Outstanding Unit Award - Vietnam Service Medal - Republic of Vietnam Campaign Medal - Air Force Longevity Service Award The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial because they are unable to verify the applicant served in Korea in order to be eligible for the KDSM. After a thorough review of the applicant’s official military personnel record they were unable to verify award of the KDSM. The applicant’s record confirms he served on multiple overseas temporary duty assignments to Japan, Vietnam and numerous temporary duty assignments which just state Southeast Asia; however, they were unable to locate any official documentation verifying service in Korea. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: In response to the Air Force Advisory, the applicant provided copies of documents related to his time in Korea. They consist of multiple AF Form 315AD, Military Boarding Passes to and from Osan, Air Base, dated 11 Jan 62, 26 Apr 62, and 20 May 62. He also provided a copy of a Personnel Authorized to Clear Red Cross letter dated 15 Nov 62 and a copy of Standard Form 48, U.S. Government Motor Vehicle Operator’s Identification Card, issued by 6314th Transportation Squadron, Osan Air Base, on 24 Nov 61. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission, to include his rebuttal comments, in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
