RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-02758 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected as follows: 1. Show that he was recalled to active duty to support Kosovo. 2. His Pay Grade be changed from staff sergeant (E-5) to technical sergeant (E-6). APPLICANT CONTENDS THAT: He left active duty and went directly to Active Reserve status. He was recalled to active duty in support of Kosovo and sent to Ft. Meade for 57 days and was subsequently promoted to the grade of E-6. He was released from Active Reserve status on 7 March 2000 via Reserve Order DA-02063 dated 8 March 2000. The Board should find it in the interest of justice to consider his untimely application because an accurate DD Form 214 is required to apply for Department of Veterans Affairs benefits. In support of his request, the applicant provides a copy of Reserve Order DA-02063 dated 8 March 2000, which relieved him from the 91st Intelligence Squadron and assigned him to the Non-obligated Non- participation Ready Personnel Section. His complete submission, with attachment, is at Exhibit A. STATEMENT OF FACTS: According to the applicant’s DD Form 214, he served with the 29th Intelligence Squadron in support of OPERATION Allied Force Kosovo from 16 May 1999 to 12 July 1999. His narrative reason for separation is “USAFR Member Released Due to Demobilization.” According to a Personal Data Report of Individual Personnel, dated 30 March 2015, the applicant’s date of rank to the grade of E-6 is 1 January 2000. AIR FORCE EVALUATION: ARPC/DPTS recommends denial. DPTS conducted a review of the applicant’s supporting documentation and the limited documents he had in his personnel records; however, none of these documents reflect that his DD Form 214 is currently incorrect. The DD 214 reflects the time he served in support of OPERATION Allied Force Kosovo. His promotion to the grade of E-6 was effective 1 January 2000; therefore, it is outside the inclusive dates of the DD 214 in question. Should the applicant provide supporting documents, such as orders placing him on active duty, points summary, or pay records, DPTS can correct the applicant’s DD Form 214 reflecting his active duty service. The complete DPTS evaluation, with attachments, is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 20 October 2014, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
