RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-02967 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His mobilization travel orders be extended from to to allow him to utilize his leave upon completion of mobilization in support of Operation . Further, he should have earned 12 days of leave but is being advised he only earned 8 days. APPLICANT CONTENDS THAT: Delays in the arrival of replacement forces delayed his return from an oversea deployment, preventing him from taking all leaved earned during this mobilization period. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving as a member of the Air National Guard in the grade of senior airman (E-4). According to documentation provided by the applicant, his name is listed on group special mission travel orders, in support of Operation , from , to and return to , with a proceed date of on/about , for a period of 183 days. The remaining relevant facts pertaining to this application are described in the memoranda prepared by the Air Force offices of primary responsibility (OPR), which are included at Exhibits C and D. AIR FORCE EVALUATION: NGB/A1P recommends granting relief in the form of correcting the applicant’s end of tour date from to . In accordance with AFI 36-3003, Military Leave Program, the applicant earned 22.5 days of regular leave during the orders period of through , as documented by the Defense Joint Military Pay System. The applicant was granted 14 days (the maximum downtime) of Post Deployment Stand-Down Time (PDSDT) based on his 183 days deployed time-in-theater, in accordance with Air Combat Command Policy. The Deliberate and Crisis Action Planning and Execution Segments (DCAPES) records showed his original deployment time-in-theater end date of ; however, according to his travel voucher, the actual end date was (an additional nine days). His to orders only afforded him 24 days to use PDSDT (14 days) and Regular Leave (22.5 days), a total of 36.5 days. Therefore, it is recommended to correct his military records and compensation of military pay, points, and applicable benefits for 12.5 days (36.5 minus 24), by updating the end date of tour from to . The applicant is not required to use, sell, or lose their earned leave at the end of an active duty tour. He may carry over leave earned during an active duty tour for use during a future active duty tour. Alternatively, he may receive payment for accrued leave. A complete copy of the NGB/A1P evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluations was forwarded to the applicant on 16 Jan 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. ? THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that he was not released from active duty, per Order Number , on , but was continued on active duty until , and is entitled to all pay and allowances during that period.
