RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03114 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, corrected to reflect he was awarded the Air Force Commendation Medal (AFCM). APPLICANT CONTENDS THAT: He was awarded an AFCM at the time of his discharge but it did not get properly updated in his records. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 9 Dec 87, the applicant initially entered the Regular Air Force. On 24 Feb 97, according to information provided by the applicant, he was awarded the AFCM with inclusive periods of service from 27 Feb 95 to 13 Mar 97. On 13 Mar 97, the applicant was furnished an honorable discharge, and was credited with nine years, three months, and five days of active service. The remaining relevant facts pertaining to this application are described in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is included at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends to grant relief to award the AFCM, indicating there is evidence of an error or injustice. The AFCM is awarded to members of the Armed Forces of the United States, below the grade of Colonel and foreign military personnel, who, while serving in any capacity with the Department of the Air Force, after 24 Mar 58, distinguish themselves by outstanding achievement or meritorious service. After a thorough review of the applicant's official military personnel record, no evidence exists to verify previous award of the AFCM or the Special Order awarding him the AFCM. The Special Order is the official source documentation for verification of an authorized decoration. However, the applicant provided what appears to be an authentic copy of a citation with the official seal and a signed certificate for award of the AFCM. Based on the evidence provided by the applicant, it is recommended to approve the applicant’s request. Additionally, it was determined the applicant's service from 9 Dec 87 to 13 Mar 97 rendered him eligible for the Air Force Outstanding Unit Award with two Bronze Oak Leaf Clusters, the Air Force Organizational Excellence Award with one Bronze Oak Leaf Cluster, and Korean Defense Service Medal, but the awards were not reflected in his records. Upon final board decision, the applicant's official military personnel record will be administratively corrected. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 10 Oct 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. In this regard, we were convinced the copy of a citation with the official seal and signed certificate for award of the AFCM were sufficient evidence the award was erroneously omitted from the applicant’s record. Therefore, we recommend the applicant's records be corrected as indicated below. ? THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that his DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect he was awarded the Air Force Commendation Medal, for the period of service of 27 Feb 95 to 13 Mar 97.
