RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03366 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Overseas service ribbons be awarded and recorded in his military personnel records. APPLICANT CONTENDS THAT: He served on two short tours and three long tours. According to the overseas tour criteria, he should be eligible for these awards. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 14 Mar 58, the applicant entered the Regular Air Force. On 31 Mar 78, the applicant was relieved from active duty and retired, effective 1 Apr 78. He was credited with 20 years and 17 days of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends disapproval for award of the Air Force Overseas Ribbon-Short Tour with one Bronze Oak Leaf Cluster and the Air Force Overseas Ribbon-Long Tour with two Bronze Oak Leaf Clusters. The applicant’s active duty service dates are from 14 Mar 58 to 31 Mar 78. Based on his dates of service, he is ineligible for award of the Air Force Overseas Ribbon. The applicant was not serving on active duty as of 6 Jan 86; therefore, he would not qualify for retroactive eligibility. The Air Force Overseas Ribbon was authorized by the Chief of Staff, United States Air Force, 12 Oct 80. The ribbon was authorized to be awarded to Air Force and Air Force Reserve members credited with completion of an overseas tour on or after 1 Sep 80. Only individuals serving on active duty as of 6 Jan 80 are eligible to have the Air Force Overseas Ribbon applied retroactively for completion of an overseas tour. Based on DPSID’s review of the applicant’s official military personnel record, they were able to determine that the below Air Force Medals and/or Ribbons should be have awarded during the applicant’s service from 14 Mar 58 to 31 Mar 78 and were not reflected in his records. Upon final board decision, administrative correct of the applicant’s official military personnel record will be completed by AFPC/DPSOR: *Air Force Longevity Service Award with four Bronze Oak Leaf Clusters (AFLSA w/4BOLC) *Air Force Good Conduct Medal with four Bronze Oak Leaf Clusters (AFGCM w/4BOLC) *Korean Defense Service Medal (KDSM) The complete DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 Feb 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting correction of the applicant’s records to reflect his entitlement to the Air Force Overseas Ribbon-Short Tour and Air Force Overseas Ribbon-Long Tour. We took notice of the applicant's complete submission, including attachments, in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
