RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03546 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her records be corrected to reflect that she entered the Uniform Services University of the Health Sciences (USUHS) on 14 Sep 81 per Directive Number 974 (Docket No. 85-01200). APPLICANT CONTENDS THAT: The error occurred as a result of her name change after she remarried. The Air Force has documents with three different names; however, her Social Security Number (SSN) never changed. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The relevant facts pertaining to this application are contained in the memorandums prepared by the Air Force offices of primary responsibility (OPRs), which are attached at Exhibits C and D. AIR FORCE EVALUATION: AFPC/DPANE deferred to DPSIPV for service dates and pay date review and correction indicating they verified the applicant’s time spent attending USUHS, as well as the different names that she used while in USUHS and on active duty. The complete DPANE evaluation is at Exhibit C. AFPC/DPSID recommends denial. However, indicates an administrative correction order was forwarded to AFPC/DPSO to request that the following statement be included on the applicant’s DD Form 214, Certificate of Release or Discharge from Active Duty, “Member attended Uniform Services University of the Health Sciences in active duty status in accordance with Title 10, Section 2114(B) from 11 Jun 82 to 16 May 86, though time is not creditable for retirement per Title 10, USC, Section 2126.” On 11 Jun 82, the applicant commissioned to participate as a student at USUHS. On 16 May 86, she completed the program and on 17 May 86, she entered extended active duty as a Medical Corps regular officer. The applicant and 44 other former USUHS students from her graduation class were later granted constructive service credit for pay in accordance with SAF/MICB (S) 85-01178 thru 85-01222, dated 5 Apr 85, Directive Number 974. The basis of this approval was to show that, on 14 Sep 81, these individuals were enrolled, not entered, into the USUHS program in order to meet the pre-Defense Officer Personnel Management Act (DOPMA) eligibility for constructive service credit for pay while on active duty. Crediting them with active duty service or changing their actual start date was not addressed or approved by SAF/MICB. The complete DPSID evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 18 May 15 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of AFPC/ DPSID and its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. 4. The applicant’s case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved. Therefore, the request for a hearing is not favorably considered. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
