RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04060 COUNSEL: NONE HEARING DESIRED: YES APPLICANT REQUESTS THAT: Her Permanent Change of Station (PCS) orders be changed to reflect a No-Cost move. APPLICANT CONTENDS THAT: Her PCS from Arlington, Virginia to Fort Meade, Maryland was no cost to the Air Force because she did not change her residence. She requested a waiver through her losing Military Personnel Flight (MPF); however, she did not receive approval prior to her reassignment. She submitted her waiver request for a no cost/low cost move so that she would be able to maintain her previous Basic Allowance for Housing (BAH) rate at Arlington, Virginia vice Ft. Meade, Maryland. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: According to Special Order (SO) Number: AG-110629, dated 25 Jun 13, the applicant was reassigned from Arlington, VA to Fort George Meade, Maryland. Item 19, Authority and PCS Code, reflects PCS ID: E (which denotes a fully funded PCS). AIR FORCE EVALUATION: AFPC/DPAPSF recommends approval, indicating a change to the original PCS fund code ("E" to "V") is warranted. DPAPSF notes that although the applicant has a fully funded PCS order made consistent with normal PCS selection criteria, she did not change residences and a low-cost PCS would have been in the best interest of both the applicant and the Air Force and would have been approved. Approval at the Board level appears warranted since she would likely have been approved for a low-cost PCS, had the assignment point of contact sent the low-cost letter to the appropriate authorizing officials. The complete DPAPSF evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 29 Dec 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. In addition, we note, in part, the applicant’s reason for requesting the no-cost/low cost move was to waive the rate change to her BAH. DPAPSF has granted this relief to applicants similarly situated as a part of the entitlement afforded members who are approved for a Permanent Change of Station (PCS) assignment at no cost to the Air Force. In view of this, we believe the applicant’s record should be corrected in a manner that includes a BAH waiver and that this will provide her full and fitting relief. Therefore, we recommend the applicant's records be corrected to the extent indicated below. 4. The applicant’s case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved. Therefore, the request for a hearing is not favorably considered. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that: a. Special Order No. AG-110629, dated 25 Jun 13, be amended in Block 19, Authority and PCS Code, to reflect a PCS ID of “V” vice “E.” b. Competent authority granted her a Basic Allowance for Housing (BAH) waiver effective 30 Sep 13 to retain the BAH rate of her previous duty location in Arlington, Virginia.
