RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04254 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be continued on Medical Continuation (MEDCON) orders, effective 11 Aug 13. APPLICANT CONTENDS THAT: His case was not handled properly as the proper Line of Duty (LOD) determination was not submitted prior to his active duty orders ending. An administrative LOD was submitted with sections cross out when a proper interim LOD should have been submitted. As a result, all requests were rejected as they were incomplete and unacceptable packages. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant’s DD Forms 214, Certificate of Release or Discharge from Active Duty for the periods in questions reflects that he served on active duty from 1 Apr to 10 Aug 13 and from 6 Jan to 17 Jul 14. AIR FORCE EVALUATION: AFPC/DPFA recommends approval, indicating the applicant’s LOD was not processed IAW applicable guidelines per discussion with Medical Case Manager. If the LOD had been processed according to guidelines, on 11 Aug 13, the applicant would have been eligible for MEDCON orders. The applicant’s Recovery Care Coordinator provided a written statement confirming administrative errors beyond the applicant’s control. His injuries were confirmed In the Line of Duty (ILOD), as well as his eligibility for MEDCON at the end of the active duty Title 10 tour. According to SAF MEDCON guidelines (Aug 2012), an Airman may be eligible for MEDCON orders when an injury, illness, or disease is incurred or aggravated while serving on orders and that condition renders the Airman unable to perform military duties. MEDCON eligibility requires a LOD determination and a finding by a credentialed military health care provider that the Airman has an unresolved health condition requiring treatment (with active treatment plan) and renders the Airman unable to meet retention or mobility standards IAW AFI 48-123, Medical Examinations and Standards, Chapters 5 and 13. DPFA is not involved with Pre- MEDCON coordination, validation or approval. The applicant was placed on MEDCON orders from 6 Jan 14 through 17 Jul 14, and was ultimately returned to duty. The applicant should have been placed on MEDCON orders at the conclusion of the Title 10 military service tour which ended on 10 Aug 13. The complete DPFA evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 25 Mar 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that for the period 11 Aug 13 through 5 Jan 14, he was placed on active duty, for the purposes of medical continuation in accordance with Title 10, U.S.C. § 12301(h).
