RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04544 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: She be reinstated her promotion line number to the grade of Technical Sergeant (TSgt) for promotion cycle 12E6. APPLICANT CONTENDS THAT: She was miscounseled about the Air Force Specialty Code (AFSC) in which she would be considered for promotion to the grade of TSgt during promotion cycle 12E6. She entered Recruiting in Dec 2011 and tested for promotion to the grade of TSgt in Mar 2012. When she signed her AF form 1566, she noticed it reflected that she was testing under her old career field (2Wl51-Armament Systems Technician) instead of Recruiting. She questioned it before she signed and the provider of the 1566 checked into a computer system and confirmed that she had to test under the 2Wl5l career field. She took both parts of the test (Professional Development Guide (PDG) and Skills Knowledge Test (SKT)) for AFSC 2Wl51. Test results for that year came out and she was notified that she made TSgt under the 2Wl51 career field; however, because she had taken the wrong test, she did not receive the promotion. She did her diligence to ensure she was taking the right WAPS test. Testing for promotion the grade of TSgt in the 2Wl5l career field consisted of her studying information in a total of 8 books (SKT and PDG) instead of the one for Recruiting (PDG). She did what she was told and believes she is being punished for something that was out of her control. In support of her request, the applicant provides a one-page typed statement, a memorandum from the Test Control Officer (TCO), indicating she tested on both Promotion Fitness Examination (PFE, now called PDG) and SKT but later discovered she was supposed to test PFE only and a statement from the Inspector General’s office. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of Staff Sergeant (SSgt). According to the AFRS Form 1321, Recruiter Evaluation, on 1 Dec 11, the applicant was assigned to the Air Force Recruiting Squadron (AFRS) as an Enlisted Accessions Recruiter. According to the AFRS Form 1321, on 13 Dec 13, the applicant was released from her duties for continued unwillingness to follow direction and comply with Air Force and AFRS standards. AIR FORCE EVALUATION: AFPC/DPSOE recommends denial indicating there is no evidence of an error or an injustice. The applicant was never considered or selected for promotion in the 2W1X1 (Armament Systems) AFSC. However, she was considered and non-selected for promotion to TSgt during cycle 12E6 in the correct AFSC, 8ROOO (Recruiting). The Weighted Airman Promotion System (WAPS) file reflects that the applicant's Current Air Force Specialty Code (CAFSC) of 8ROOO was updated in Dec 11. The system also shows that the applicant was considered for promotion in the initial selection process as an 8ROOO in May/Jun 12 and was non-selected. There is nothing in the promotion system reflecting that the applicant was ever considered or selected for promotion as a 2W1Xl. The applicant has not provided her selection score notice for AFSC 2W1Xl with her application. Members compete for promotion in the CAFSC they hold at the promotion eligibility cutoff date (PECD). The PECD for promotion cycle 12E6 was 31 Dec 11. At the time of the applicant’s PECD, WAPS reflected her AFSC as 8ROOO, effective 1 Dec 11. IAW AFI 36-2101, Classifying Military Personnel (Officer and Enlisted), Table 3.9, Note 2, CAFSC effective date (for retraining through a formal school {including special duty}) is the date departed current duty station Permanent Change of Station (PCS), Permanent Change of Assignment (PCA). Based on applicant's Training Record and Recruiter Evaluation, she attended Recruiter School in Nov 11 and started duties as a Recruiter on 1 Dec 11. On 6 Mar 12, the applicant tested for promotion at cycle 12E6. The WAPS file for every month between Dec 11 and Mar 12 reflects the applicant's AFSC as 8ROOO. Additionally, there are no provisions that would allow an individual to compete for promotion in an AFSC to which they were not assigned. A complete copy of the AFPC/DPSOE evaluation, with attachment, is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant asserts that she was never given an opportunity to take the Specialty Knowledge Test (SKT) [sic] only. She states that upon receiving the initial testing notification, she questioned the reason she had to test in her old career field. In fact, she questioned the matter three times and was told the system reflected that she was supposed to take both the SKT and Promotion Fitness Examination (PFE) tests. She was initially considered for promotion as a 2W171 under the WAPS test and was selected for promotion but once the mistake was noticed that she had taken the wrong test, her score was updated in the system to reflect she tested for the 8R000 career field and that she was a non-selectee for promotion. She was miscounseled in every way as to what WAPS test she was suppose take that year. In support of her response, the applicant provides copies of her WAPS notification for promotion cycle 12E6 and a statement from the Unit Program Coordinator indicating the applicant was administered the SKT and PFE tests and after the scores were released, an error was discovered and only her PFE was scored. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. The applicant contends that because she was allowed to test for promotion in her former Air Force Specialty Code (AFSC) and, because she was selected for promotion to the grade of TSgt, she is the victim of an injustice. However, after a thorough review of the evidence of record and the applicant’s complete submission, including her rebuttal response, we are not convinced the evidence provided is sufficient to conclude she is the victim of an error or injustice. In this respect, we note the comments of the Air Force office of primary responsibility indicating the applicant has provided no evidence to indicate that she was allowed to test for promotion in her former AFSC. We note that in response the applicant provided a letter from the Unit Program Coordinator indicating she was allowed to test on both the PFE and SKT; however, the applicant has provided no evidence to indicate that she was selected for promotion to the grade of TSgt based on this test. Even if we assume for the sake of argument that she was erroneously selected for promotion to the grade of TSgt, we are not convinced such an error would form a basis for us to recommend relief be granted. In this respect, we note that, while regrettable, some Air Force members are erroneously selected for promotion, only to have the selection rescinded when the error is discovered during data verification. As such, even if the applicant was erroneously selected for promotion as a result of being allowed to test for promotion in her old AFSC, she has not presented any evidence she was treated any differently than others similarly situated— those erroneously selected for promotion. Therefore, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
