ECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04729 COUNSEL: NONE HEARING DESIRED: YES APPLICANT REQUESTS THAT: His records be corrected to reflect award of the Kuwait Liberation Medal (KLM), Humanitarian Service Medal (HSM) and the Air Force Achievement Medal (AFAM) (administratively resolved). APPLICANT CONTENDS THAT: He served at Incirlik Air Base (AB), Turkey from Jun 90 to Dec 91, during Operation PROVIDE COMFORT and was there when Kuwait was being invaded. The KLM, HSM, AFAM are missing from his DD Form 214, Certificate of Release or Discharge from Active Duty. The applicant’s complete submission, with attachment, is at Exhibit A. STATEMENT OF FACTS: On 11 Jan 90, the applicant commenced his enlistment in the Regular Air Force. The applicant’s Enlisted Performance Report (EPR) for the period 11 Jan 90 through 16 Aug 91 reflects he was stationed at Incirlik AB, Turkey. The EPR further notes he provided support for various missions in support of Operations DESERT STORM and PROVIDE COMFORT. By Special Order GA-66 dated 5 Jun 91, the applicant was awarded the AFAM for outstanding achievement for the period 17 Jan 91 to 1 Apr 91. On 10 Jan 94, the applicant was furnished an honorable discharge, and was credited with four years of active service and transferred to the Air Force Reserve where he served until his release on 20 Sep 97. The HSM was authorized to honor personnel of the Armed Forces of the United States who distinguished themselves by meritorious direct participation (hands on) in a significant military act or operation of a humanitarian nature, or have rendered a service to mankind. Specifically excluded from eligibility are service members or elements remaining at a geographically separated location or to a location and did not make a direct contribution to influence the action. The KLM (Saudi Arabia) – is awarded to U. S. military personnel who served in support of Operation DESERT STORM between 17 Jan and 28 Feb 91, in one or more of the following areas; the Persian Gulf, Red Sea, Gulf of Oman, that portion of the Arabian Sea that lies north of 10 degrees north latitude and west of 68 degrees east longitude; Gulf of Aden; or, the total land areas of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar and United Arab Emirates. The KLM (Kuwait) – is awarded to U. S. military personnel who served in support of Operations DESERT SHIELD/STORM between 2 Aug 90 and 31 Aug 93. They had to be in one or more of the following areas; the Persian Gulf, Gulf of Oman, that portion of the Arabian Sea that lines north of 10 degrees north latitude and west of 68 degrees east longitude; Gulf of Aden; or, the total land areas of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar, and United Arab Emirates. AIR FORCE EVALUATION: AFPC/DSID recommends denial indicating there is no evidence of an error or an injustice. The applicant’s records reflect he served in Turkey; however, Turkey is not in the area of eligibility (AOE) for the KLM-Kuwait or KLM-Saudi Arabia. Furthermore, while the applicant did serve at Incirlik AB, he did not serve during the inclusive period for award of the HSM. In addition, a review of the applicant’s records revealed he is entitled to the AFAM and the Southwest Asia Service Medal with one Bronze Service Star (SWASM w/w1BSS) and his records will be administratively corrected to reflect the AFAM and SWASM w/1BSS. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 11 Jun 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. The applicant requested award of the KLM and while his records reflect he served in Turkey, he did not serve in the AOE for award of the KLM for Kuwait or Saudi Arabia. The applicant also requested award of the HSM, however, there is no evidence he served in the AOE during the inclusive period for the HSM. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted. Therefore, we find no basis to favorably consider this application. 4. The applicant’s case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved. Therefore, the request for a hearing is not favorably considered. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
