RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04844 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Report of Separation from Active Duty, be corrected to reflect the award of the Small Arms Expert Marksmanship Ribbon (SAEMR). APPLICANT CONTENDS THAT: He did some research and found that he qualified with a rifle in basic training for the SAEMR and would like his record updated. In support of his request, the applicant provided a copy of AF Form 522, Small Arms Marksmanship Training Data, dated 13 Dec 72. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 9 Nov 72. On 21 Jul 77, the applicant was furnished an Honorable discharge, and was credited with 4 years, 8 months, and 13 days of active service. The applicant’s DD Form 214 and DD Form 215, Correction to DD Form 214, Certificate of Release or Discharge from Active Duty, reflects the following Air Force Medals and/or Ribbons: - Air Force Outstanding Unit Award - National Defense Service Medal - Air Force Longevity Service Award - Air Force Good Conduct Medal The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The Small Arms Expert Marksmanship Ribbon was authorized by the Secretary of the Air Force on 28 Aug 62 and is awarded to all United States Air Force members who after 1 Jan 63, qualify as “expert” in small-arms marksmanship with either the M-16 rifle or issue handgun. Qualification as “expert” in both weapons after 22 Jun 72 shall be denoted by a bronze service star worn on the service ribbon. After a thorough review of the applicant’s official military personnel record, they were unable to verify the award of the SAEMR. While the applicant provided an AF Form 522, they were unable to locate any official documentation verifying he scored “expert” on the rifle or handgun. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 30 Mar 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. FINDINGS AND CONCLUSIONS OF THE BOARD: After careful consideration of applicant’s request and the available evidence of record, we find the application untimely. Applicant did not file within three years after the alleged error or injustice was discovered as required by Title 10, United States Code, Section 1552 and Air Force Instruction 36-2603. Applicant has not shown a plausible reason for the delay in filing, and we are not persuaded that the record raises issues of error or injustice which require resolution on the merits. Thus, we cannot conclude it would be in the interest of justice to excuse the applicant’s failure to file in a timely manner. THE BOARD DETERMINES THAT: The application was not timely filed and it would not be in the interest of justice to waive the untimeliness. It is the decision of the Board, therefore, to reject the application as untimely.
