RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04853 COUNSEL: NONE HEARING DESIRED: YES APPLICANT REQUESTS THAT: His two non-selections for promotion by the Calendar Year 2013 (CY13) and Calendar Year 2014 (CY14) Nonparticipating Reserve (NPR) Line Lieutenant Colonel (Lt Col) Promotion Selection Boards be removed from his record. APPLICANT CONTENDS THAT: He was involuntarily separated from active duty after 15 years of service as a rated officer (pilot) due to budget cutbacks. At the time of his separation he was not briefed and was unaware that he would continue to meet promotion boards while in the Individual Ready Reserve (IRR). He was not briefed about any method to contact the promotion board to provide inputs for their consideration. He was never notified and was unaware of the consequences of being twice passed over while in the IRR. He desires to continue to serve his country. He has a clean military record with no administrative actions and he has been contacted by an Air National Guard unit that would like to hire him. The applicant’s complete submission is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 6 January 1997. On 30 November 2011, the applicant, according to his DD Form 214, Certificate of Release or Discharge from Active Duty, was furnished an honorable discharge, and was credited with 14 years, 10 months, and 25 days of active service, to include 6 years and 15 days of foreign service. Upon his discharge from active duty, the applicant was reassigned/transferred to the Air Force Reserve. The applicant was considered, but not selected, by the CY13 and CY14 USAFR Nonparticipating Reserve (NPR) Line Lieutenant Colonel Promotion Selection Boards, which convened on 10 June 2013, and 9 June 2014. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: ARPC/PB recommends denial. PB states the applicant was assigned to the Non-obligated Non-participating Ready Personnel Section (NNRPS) when both boards convened. Although members in NNRPS are not in a participating status, they are considered to be on the Reserve Active Status List (RASL). In accordance with Title l0 USC, Section 14301, all officers on the RASL must be considered for promotion when eligible. The CY13 USAFR NPR Line Lt Col Promotion Selection Board considered 94 officers and had a quota of one (1). The CY14 USAFR NPR Line Lt Col Promotion Selection Board considered 21 officers, and also had a quota of one (1). PB cannot find any evidence, nor has the applicant presented any evidence, to prove the boards acted contrary to law or regulation, or that his record contained any errors when considered by the boards. The applicant states he was never notified and was unaware of the consequences of being twice passed over while in the IRR. In accordance with AFI 36-2504, Officer Promotion, Continuation and Selective Early Removal in the Reserve of the Air Force, paragraph 1.3.2, the ARPC Board Support Branch notifies all nonparticipating candidates of their promotion eligibility. A notification letter and Officer Preselection Brief (OPB) are mailed to each candidate’s residence approximately four months prior to each promotion board. They cannot confirm if the applicant’s mailing address was correct in the Military Personnel Data System or if the applicant actually received the notification and OPB. A board convening notice is also posted to the MyPers website announcing each board. In accordance with AFI 36-2504, paragraph 1.7, it is the eligible officer’s responsibility to monitor their own eligibility and ensure their selection record is correct and up- to-date before the convening of the selection board. A complete copy of the ARPC/PB evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 January 2015 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application is timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our conclusion the applicant has not been the victim of an error or injustice. Despite the applicant’s assertion that he was not briefed on the Air Force Reserve promotion process, the Board finds no evidence of an error or injustice against the applicant. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. 4. The applicant’s case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved. Therefore, the request for a hearing is not favorably considered. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of an error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
