RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04916 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records be corrected to reflect that he was promoted to the grade of Senior Airman (SrA, E-4), effective 14 Jun 13 instead of 1 Oct 14. APPLICANT CONTENDS THAT: He was misidentified as ineligible for promotion due to an outdated policy memorandum. In support of his request the applicant provides copies of a letter dated 23 Oct 14, from the Air National Guard’s Force Management Directorate (NGB/A1P) and a letter from his congressman. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: According to the Military Personnel Data System (MILPDS), the applicant is currently serving in the Air National Guard (ANG) in the grade of SrA, with a date of rank of 1 Oct 14. AIR FORCE EVALUATION: NGB/A1PP recommends approval. The applicant was misidentified as ineligible for promotion due to an outdated policy memorandum. The National Guard Bureau, Office of Legislative Liaison (NGB-LL) indicates that NGB/A1P determined that the applicant became eligible for promotion on 14 Jun 13, which is the original date the commander recommended. The complete A1PP evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 3 Jun 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that he was promoted to the grade of senior airman (E-4), effective and with a date of rank of 14 Jun 13, instead of 1 Oct 14.
