RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-05095 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect award of the Air Force Combat Action Medal (AFCAM). APPLICANT CONTENDS THAT: His records contain documentation showing he participated in several combat loads in support of operations JOINT GUARDIAN and ALLIED FORCE. He received combat and hazard duty pay for the time periods he conducted the combat loads. He is seeking mental health care through the Department of Veterans Affairs (DVA). The applicant’s complete submission is at Exhibit A. STATEMENT OF FACTS: On 24 Jul 96, the applicant commenced his enlistment in the Regular Air Force. The applicant’s citation for award of the Air Force Achievement Medal for the period 14 Feb 97 to 28 Feb 99, indicates he contributed to two highly successful combat deployments. The applicant’s enlisted performance report (EPR) for the period 24 Mar 98 thru 29 Jan 99, reflects he was deployed in support of Operation NORTHERN WATCH. The applicant’s EPR for the period 30 Jan 99 thru 29 Jan 00, reflects he performed 12 zero defect combat loads during Operations JOINT GUARDIAN and ALLIED FORCE. On 22 Jul 00, the applicant was furnished an honorable discharge, and was credited with four years of active duty service. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The applicant does not meet the criteria for award of the AFCAM. The applicant’s service dates are outside of the awarding dates for the AFCAM. The AFCAM was established to recognize Air Force military members, from 11 Sep 01 to a date to be determined, who actively participated in air or ground combat within a designated combat zone in combat conditions. To qualify for the award, an individual must have come under direct and hostile fire while operating in unsecured space outside the defended perimeter or, if inside a defended perimeter, served in a defensive capacity. Retroactive awards prior to 11 Sep 01 are not authorized. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 Mar 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. FINDINGS AND CONCLUSIONS OF THE BOARD: After careful consideration of applicant’s request and the available evidence of record, we find the application is untimely. Applicant did not file within three years after the alleged error or injustice was discovered as required by Title 10, United States Code, Section 1552 and Air Force Instruction 36-2603. Applicant has not shown a plausible reason for the delay in filing, and we are not persuaded that the record raises issues of error or injustice which require resolution on the merits. Thus, we cannot conclude it would be in the interest of justice to excuse the applicant’s failure to file in a timely manner. THE BOARD DETERMINES THAT: The application was not timely filed and it would not be in the interest of justice to waive the untimeliness. It is the decision of the Board, therefore, to reject the application as untimely.
