RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-05172 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be credited with 10 months of retroactive Biomedical Science Corps (BSC) Consolidated Special Pay (CSP) Incentive Pay (IP) for 2013. APPLICANT CONTENDS THAT: He and his supervisor assumed the period to upgrade was 24 months; however, it was six months and he was not informed to submit an AF Form 2795 to update his Air Force Specialty Code (AFSC) from 42Gl (entry level) to 42G3 (qualified level). His current effective date to start the IP was 1 Mar 14; however, he was not aware that he could have started his IP effective 6 May 13, some 10 months prior, when he was upgraded to the 42G3. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 27 Aug 12, the applicant initially entered active duty in the Regular Air Force. He is currently serving as a BSC officer in the grade of captain. On 15 Mar 13, the applicant’s AFSC 42Gl (entry level) was upgraded to 42G3 (qualified level). On 1 Mar 14, the applicant signed a 1-year IP contract. AIR FORCE EVALUATION: AFPC/DPANF recommends approval for the applicant’s request for retroactive IP. DPANF notes the record should be corrected to show the applicant's IP started, on 15 Mar 13, the day he was upgraded to a three-level/qualified level. The Board would direct AFPC/DPANF to adjust the member's current 1 Mar 2014 IP contract with the 15 Mar 2014 effective date and update the member's 28 Feb 2015 ADSC to reflect 14 Mar 2015. The Board would need to notify the member in order to continue receiving IP after the 14 Mar 2015 expiration date; he would need to submit a new IP contract to AFPC/DPANF with an effective date of 15 Mar 2015. If he submits a new IP contract with a 15 Mar 2015 effective date he is accepting the 12-month (or 48-month) ADSC required in accordance with the current year's BSC CSP plan. AFPC/Medical Special Pays did not receive an IP contract from the applicant on/around 15 Mar 13 to process for pay. The applicant's official record does not indicate that he submitted a signed/endorsed IP contract on/around 15 Mar 13. However, the applicant did provide a letter from his current supervisor that indicated possible lack of BSC leadership/counseling during the time he would have completed the AF Form 2096 for upgrade in his record and submitted a 2013 IP contract. In this case, since there was a lack of BSC leadership/guidance for a new BSC accession, the applicant should be granted approval of his request for retroactive IP with a 15 Mar 13 effective date. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 6 Mar 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. In addition, we recommend an alternative correction to ensure the applicant’s corrected record reflects his current incentive pay contracts. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that: a. He elected to receive Incentive Pay (IP), under the Fiscal Year 2012 (FY12) Air Force Consolidation of Special Pays (CSP), on 15 March 2013 rather than 1 March 2014, effective for the period 15 March 2013 through 14 March 2014. b. His 1 March 2014 through 28 February 2015 IP contract be changed to reflect 15 March 2014 through 14 March 2015. c. His 1 March 2015 through 29 February 2016 IP contract be changed to reflect 15 March 2015 through 14 March 2016.
