RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00002 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be awarded the Meritorious Unit Award (MUA) and the Air Force Overseas Ribbon-Long Tour with one Bronze Oak Leaf Cluster (AFOR-LT w/1BOLC) (Administratively Resolved). APPLICANT CONTENDS THAT: He was assigned to the 510th Expeditionary Fighter Squadron and on deployment during the period for which the MUA was awarded. He should be awarded the AFOR-LT w/1BOLC for his assignments in Italy and France. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Air National Guard in the grade of Lieutenant Colonel (0-5). On 28 Jan 15, AFPC/DPAPP notified the applicant of their determination that he had “boots on ground” foreign service in the Republic of Korea, Italy, and France for a combined total foreign service of 6 years, 7 months, and 21 days. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The MUA is awarded to Air Force active duty, Reserve and Guard units for exceptionally meritorious conduct in the performance of outstanding achievement or service in direct support of combat operations for at least 90 continuous days during the period of military operations against an armed enemy of the United States on or after 11 Sep 01. The 510th Expeditionary Fighter Squadron was awarded the MUA for inclusive date 1 Jun 05 to 31 May 06; however, documentation in the applicant’s record verifies he was assigned to the 510th Fighter Squadron. Based on review of the applicant’s record, it was determined that he should have been awarded the AFOR-LT w/1BOLC. His record will be administratively corrected. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant contends the OPR has confused Special Order G-0222 inclusive date 1 Jun 05 to 31 May 06, with G-0306 inclusive date 1 Dec 03 to 31 Mar 04. In his application, he provided service history, awards and performance reports that show he was a part of the 510 Fighter Squadron/Expeditionary Fighter Squadron at the time, as well as USAF flying records that show the specific dates he flew combat sorties. The evidence already provided is quite sufficient to prove that he was a member of the Expeditionary Fighter Squadron (Exhibit E). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting award of the Meritorious Unit Award (MUA). We took notice of the applicant’s complete submission, to include his rebuttal comments, in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. We note the Air Force OPR has determined the applicant’s eligibility for the Air Force Overseas Ribbon-Long Tour with one Bronze Oak Leaf Cluster (AFOR-LT w/1BOLC) and will correct his records administratively. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting relief beyond that already granted administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
