RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00051 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: The Meritorious Unit Award (MUA) be added to his DD Form 214, Certificate of Release or Discharge from Active Duty. APPLICANT CONTENDS THAT: His unit was awarded the MUA however; it is not shown on his DD Form 214 nor did he receive the ribbon upon discharge. The applicant’s complete submission, with attachment, is at Exhibit A. STATEMENT OF FACTS: On 29 Nov 11, the applicant entered the Regular Air Force. According to AF Form 910, Enlisted Performance Report (EPR) (AB thru TSgt), period inclusive dates 29 Nov 11 thru 28 Jul 13, his organization, command, location and component is listed as XXXXX. On 24 Jul 14, the applicant was released from active duty with an honorable character of service and transferred to the Air Force Reserve component. He was credited with 2 years, 7 months and 26 days of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. After a thorough review of the applicant’s official military personnel record, DPSID was unable to verify the XXXXX Squadron was awarded the MUA. They were able to verify the applicant was assigned to the XXXXX Squadron between January 2012 and July 2014. According to the Air Force Historical Research Agency’s website, the XXXXX Squadron has only received award of the Meritorious Unit Award for the inclusive period 1 Jul 06 to 30 Jun 07. To grant relief would be contrary to the criteria established by DoDM 1348.33, Manual of Military Decorations and Awards, the Secretary of the Air Force, Chief of Staff, and/or the War Department. The Meritorious Unit Award is given to Air Force active duty, Reserve and Guard units for exceptionally meritorious conduct in the performance of outstanding achievement or service in direct support of combat operations for at least 90 continuous days during the period of military operations against an armed enemy of the United States on or after 11 Sep 01. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 2 Jan 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission, including attachments, in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. While we acknowledge the applicant’s request for award of the MUA, we note the applicant was not a member of the unit during the timeframe the MUA was awarded and believe he has not demonstrated evidence otherwise. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
