RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00073 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His Reentry (RE) code of “2X” be changed to “1J”. APPLICANT CONTENDS THAT: He left Japan on 22 Dec 14 and was unable to fix his records locally due to a base wide event and the lack of available personnel with the upcoming holiday. He desires to continue serving as a member of the Air National Guard. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 10 Feb 09. On 23 Jan 14, the applicant was non-recommended for reenlistment by his commander on AF Form 418, Selective Reenlistment Program (SRP) Consideration for Airmen in the Regular Air Force/Air Force Reserve. On 27 Jan 14, the applicant acknowledged his commander’s non- recommendation and annotated his intention to appeal the decision. On 7 Feb 14, the Military Personnel Flight (MPF) acknowledged the applicant’s appeal was not received and updated his RE code to “2X” (1st Term, 2nd Term or Career Airman not Selected under SRP). On 25 Mar 14, the MPF completed an AF Form 964, PCS, TDY, Deployments, or Training Declination Statement, after the applicant refused to obtain the required retainability for assignment consideration. By doing so the applicant acknowledged he is not eligible to reenlist, and may be ineligible to extend his enlistment. The applicant refused to sign the form. On 9 Feb 15, the applicant was furnished an Honorable discharge, and was credited with six years of active service. The applicant’s DD Form 214, Certificate of Release or Discharge from Active Duty, reflects RE code 2X and a narrative reason for separation of Non-Retention on Active Duty. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSOA recommends denial indicating there is no evidence of an error or an injustice. The applicant was non-selected for reenlistment by his commander via AF Form 418. The applicant acknowledged his commander’s decision and rendered his intent to appeal. When he failed to turn in an appeal, his RE code was updated to 2X reflecting he was not selected for reenlistment. A complete copy of the AFPC/DPSOA evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 18 Jun 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
