RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00106 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His Date of Rank (DOR) for Airman First Class (E-3) be corrected to reflect 18 Jun 13, instead of 7 Nov 14. APPLICANT CONTENDS THAT: According to ANG Instruction 36-2002, Enlistment and Reenlistment in the Air National Guard and as a Reserve of the Air Force, Table 1.6, Note 1, an individual enlisting in their senior year of high school will be enlisted in grade of E-1. Immediately upon graduation from high school and upon receipt of the required documents, the individual may be promoted to the grade of E-3, with an effective date of graduation. He provided his Force Support Squadron (FSS) a copy of his high school Diploma before departing for basic military training (BMT); however, they did not process the promotion correctly. They have since instructed him to apply for a correction through the BCMR. In support of this request, the applicant provided a copy of Special Order A3-001 promoting him to A1C effective 7 Nov 14, a copy of his enlistment contract, a copy of an unsigned letter from his Guidance Counselor attesting to his date of graduation, a copy of his high school Diploma, a copy of the FY13 Recruiting and Retention Initiatives and Excerpts from ANGI 36-2502 and ANGI 26-2002. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 9 May 13, according to his DD Form 1966/3, Record of Military Processing – Armed Forces of the United States, the applicant enlisted in the Air National Guard (ANG) in the grade of airman basic (E-1) in the 2A6x2 Air Force Specialty Code (AFSC). According to the Fiscal Year 2013 Recruiting and Retention Initiatives Program, members such as the applicant enlisting in the 2A6X2 AFSC during FY 13 are qualified for enlistment in the grade of airman first class (E-3). However, in accordance with ANGI 36-2002, Enlistment and Reenlistment in the Air National Guard, an individual enlisting prior to graduating high school will be enlisted in the grade of E-1, regardless of qualification for enlistment at a higher grade. Upon graduation from high school, the member will be promoted to the higher grade prior to departing for basic training. According to documentation provided by the applicant, he graduated high school on 18 Jun 13. On 7 Nov 14, the applicant was promoted to the grade of airman first class (E-3), effective 7 Nov 14. The remaining relevant facts pertaining to this application are described in the memoranda prepared by the Air Force office of primary responsibility (OPR), which is included at Exhibit C. AIR FORCE EVALUATION: NGB/A1PP recommends he Board approve the applicant’s request to have the effective date of his promotion to Airman First Class (E-3) corrected to 18 Jun 13. The applicant’s Force Support Squadron received his high school diploma but was unable to process the promotion before his departure to BMT. In accordance with ANGI 36-2002, Table 1.6, Note 1 and Fiscal Year 2013 Recruiting and Retention Initiatives, members who present documents for a higher enlistment grade after enlistment are advised to submit a request to the BCMR. A complete copy of the NGB/A1PP evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 26 Aug 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. As the applicant has presented evidence that he enlisted in an air force specialty code (AFSC) qualifying him for promotion to the grade of airman first class (E-3), we believe it appropriate to recommend his records be corrected to reflect he was promoted to said grade when he graduated high school on 18 Jun 13 in accordance with Fiscal Year 2013 Air National Guard Recruiting and Retention Initiatives program and ANGI 36-2002. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that the Date of Rank (DOR) for promotion to Airman First Class (E-3) be corrected to reflect 18 June 2013.
