RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00110 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be awarded the following and any other medals he may be entitled to: Armed Forces Expeditionary Medal (AFEM); Administratively corrected Joint Endeavor for Bosnia Medal (JEBM); Liberation of Haiti Medal (LHM); Armed Forces Service Medal (AFSM). APPLICANT CONTENDS THAT: He should have received the AFEM, JEBM, LHM, AFSM as well as others, but they are not on his DD Form 214, Certificate of Release or Discharge from Active Duty. Because he is entitled to all decorations, medals and campaign ribbons, he should receive them. The applicant’s complete submission, with attachment, is at Exhibit A. STATEMENT OF FACTS: On 7 Jan 93, the applicant entered the Regular Air Force. On 22 Aug 96, the applicant received an honorable discharge. He was credited with 3 years, 7 months, and 16 days of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends disapproval for award of the AFEM or the AFSM for Operation JOINT ENDEAVOR. There is no documentation in the applicant’s official military record to verify he participated in direct support of Operation JOINT ENDEAVOR. Defense Finance and Accounting Service (DFAS) was able to verify the applicant served in Haiti for the required time period. No additional foreign service, moreover, service in the area of eligibility of Operation JOINT ENDEAVOR could be validated. Based on review of the applicant’s official military personnel record, they were able to determine the below Air Force Medal and/or Ribbon should have been awarded during the applicant’s service from 7 Jan 93 to 22 Aug 96 and was not reflected in his records. Administrative correction of the applicant’s official military personnel record will be completed by AFPC/DPSOR: *Armed Forces Expeditionary Medal DPSID recommends disapproval for additional awards. They were unable to verify any additional awards other than the AFEM for the applicant’s service in Haiti from 14 Oct 94 to 12 Nov 94, as verified by the DFAS. To grant the applicant relief would be contrary to the eligibility criteria established by DoDM 1348.33. The AFEM may be awarded to members of the United States Armed Forces who after 1 Jul 58: participate, or have participated, as members of United States Military units in a United States Military operation in which service members of any Military Department participate, in the opinion of the Joint Chiefs of Staff (JCS), in significant numbers; encounter, incident to such participation, foreign armed opposition, or are otherwise placed, or have been placed, in such position that, in the opinion of the JCS, hostile action by foreign armed forces was imminent even though it did not materialize. Service members must have been permanently assigned, attached, or detailed to a unity that participated in or engaged in direct support of the operation for 30 consecutive days in a designated area of eligibility in a foreign territory (or for the full period when an operation is less than 30 days duration) or for 60 non- consecutive days provided the support involved entering the area of eligibility or met the following criteria: was engaged in actual combat, or duty that was equally as hazardous as combat duty, during the operation with armed opposition, regardless of time in the area of eligibility, or was wounded or injured and required medical evacuation from the area of eligibility while participating in the operation, regardless of time in the area of eligibility. The AFSM was established on 11 Jan 96 and is awarded to members of the Armed Forces who participate in a United States Military operation deemed to be a significant activity and who encounter no foreign armed opposition or imminent hostile action. It may be awarded to members of the United States Armed Forces who, on or after, 1 Jun 92, in the opinion of the Joint Chiefs of Staff (JCS) participate, or have participated, as members of the United States Military units, in a United States Military operation in which personnel of any United States Armed Forces participate that is deemed to be a significant activity and encounter no foreign armed opposition or imminent hostile action. Service members must have been permanently assigned, attached, or detailed to a unit that deployed to participate in a United States Military operation within a designated area of eligibility for 30 consecutive days (or for the full period when an operation is of less than 30 days duration) or for 60 non- consecutive days provided this support involves entering the area of eligibility or participated as a regularly assigned crew member on an aircraft flying into, out of, within, or over the area of eligibility in direct support of the designated military operation for 30 consecutive days or 60 non-consecutive days. One day of service is credited for the first sortie flown on any day. Additional sorties flown on the same day receive no further credit. The AFSM was awarded in addition to the AFEM as a one-time exception to policy for service in direct support of Operation JOINT ENDEAVOR between 20 Nov 95 and 19 Dec 96. The area of eligibility for the AFEM is Bosnia-Herzegovina or Croatia, or aboard United States Naval vessels operating in the Adriatic Sea, or the respective airspace of these areas. The area of eligibility for the AFSM is the Former Republic of Yugoslavia, Hungary, Italy and the waters and air space above that portion of the Adriatic Sea that lines north of forty degrees north latitude. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 2 Jun 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting correction of the applicant’s records to reflect his entitlement to the JEBM, LHM and AFSM. We took notice of the applicant's complete submission, including attachment, in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force OPR and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. We note the Air Force OPR has determined the applicant’s eligibility for the AFEM for his deployment to Haiti and will correct his records administratively. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
