AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00123 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He receive Early Career Incentive Special Pay (ECISP), effective 1 Dec 14. APPLICANT CONTENDS THAT: In 2013, he was told by the Medical Special Pays section at AFPC that based on the Fiscal Year 2014 (FY14) Medical Corps (MC) Legacy Pay Plan he could renegotiate his Incentive Specialty Pay (ISP) contract to receive ECISP, but not until 20 Nov 14. However, in Nov 14 the same office told him he was not eligible for ECISP as of 1 Oct 14 because he had over eight years of creditable service per the FY15 MC Special Pay Plan. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 21 May 05 in the grade of captain after graduating from the Uniformed Services University of Health Sciences (USUHS). According to the documentation provided by the applicant on 30 Dec 14 he applied for ECISP, effective 1 Dec 14, and was denied because he had over 8 years of creditable service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPANF recommends denial indicating there is no evidence of an error or an injustice. Each year the Air Force determines if medical bonuses are needed, and who should receive them. The program qualifications change from year to year. ECISP incentivizes members with less than eight years of creditable, who are within 18 months of the end of their active duty service commitments (ADSCs), to remain on active duty for a longer period of time. In 2013, the member was not eligible for ECISP based upon the criteria in the FY14 MC Pay Plan because he was not within 18 months of completing his ADSC, but was informed he would be eligible beginning in Nov 14. However, the criteria for qualifying for ECISP changed in the FY15 MC Pay Plan. Members with over eight years of service are not eligible for ECISP. When the applicant was within 18 months of his completing his ADSC in Nov 14, he had over 8 years of service credit, which disqualified him for the FY15 Pay plan. The applicant is requesting the Board grant him a bonus for which he was not qualified or entitled to receive. A complete copy of the AFPC/DPANF evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 28 Apr 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of AFPC/DPANF and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
