RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00124 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His deceased son’s DD Form 214, Certificate of Release or Discharge from Active Duty, Block 12f, Foreign Service, be corrected to reflect his multiple deployments overseas. APPLICANT CONTENDS THAT: He would like his late son’s children to have an accurate account of their father’s service. His son served overseas on several occasions; however, his DD Form 214 does not reflect any Foreign Service. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The deceased former member initially entered the Regular Air Force on 18 May 93. The deceased former member’s 18 Jan 96 thru 15 Oct 96, AF Form 910, Enlisted Performance Report (AB Thru TSgt), Section V, Rater’s Comments, 1st bullet identifies he deployed to Kuwait in support of Operation SOUTHERN WATCH. This same EPR in Section VI, Indorser’s Comments, 2nd main bullet identifies he deployed to Dhahran, Saudi Arabia. No length of time is captured related to either statement. On 17 May 97, the deceased former member was furnished an Honorable discharge, and was credited with four years of active service. The deceased former member’s DD Form 214, Block 12f, does not reflect any Foreign Service. Pursuant to the Board’s request, the Defense Finance and Accounting Service advised that their pay system reflects the deceased former member received Hostile Fire Pay and Combat Zone Tax Exclusion during the following time periods: 13 Dec 95 through 13 Mar 96 while serving in Kuwait and from 10 Sep 96 through 28 Sep 96 while serving in the Kingdom of Saudi Arabia. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPAPP completed a thorough review of the deceased former member’s official military personnel record. While they note several entries on his EPRs that indicate he deployed to Kuwait and the Kingdom of Saudi Arabia, they were unable to determine the length of time. Therefore, they were unable to correct the Foreign Service on his DD Form 214. They recommend the Board review his master personnel record to determine if they are able to award the appropriate Foreign Service time. A complete copy of the AFPC/DPAPP evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 6 Jul 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed. While the applicant claims a date of discovery of less than three years ago, in our view, the reasonable date of discovery of the alleged error or injustice was more than three years ago and the application is therefore untimely. However, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After a thorough review of the evidence of record and the applicant’s complete submission, we believe the deceased former member is the victim of an error or injustice. We took note that AFPC/DPAPP was able to discern through the enlisted performance reports that the deceased former member was deployed to Kuwait and the Kingdom of Saudi Arabia; however, they were not able to determine the length of time of these deployments. Pursuant to our request, the Defense Finance and Accounting Service advises that their pay system reflects the deceased former member received Hostile Fire Pay and Combat Zone Tax Exclusion for serving in both Kuwait and the Kingdom of Saudi Arabia during 13 Dec 95 through 13 Mar 96 and 10 Sep 96 through 28 Sep 96, respectively. Therefore, based on the totality of the evidence presented, we recommend the applicant’s records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the DECEASED FORMER MEMBER be corrected to show on 17 May 1997, his DD Form 214, Certificate of Release or Discharge from Active Duty, Block 12f, Foreign Service, reflect 0 years, 3 months, and 20 days.
