RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00195 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect the following awards and decorations: 1. Presidential Unit Citation with one Bronze Oak Leaf Cluster (PUC w/1OLC). 2. Air Force Good Conduct Medal (AFGCM). (Administratively resolved). 3. Air Force Longevity Service Award (AFLSM). (Annotated on DD Form 214, dated 5 Mar 69, no action required). 4. Air Force Overseas Ribbon-Short Tour (AFOST). 5. Air Force Overseas Ribbon-Long Tour (AFOLT). 6. Air Force Achievement Medal (AFAM). 7. Air Force Outstanding Unit Award (AFOUA). (Administratively resolved). APPLICANT CONTENDS THAT: He was awarded the aforementioned awards and decorations while on active duty. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 7 Aug 62. On 5 Mar 69, the applicant was furnished an honorable discharge, and was credited with 6 years, 6 months, and 29 days of active service, including 1 year, 8 months, 27 days of foreign service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice regarding the applicant’s requested relief to award him the PUC w/1OLC, AFAM, AFOST, and AFOLT. The PUC is awarded in the name of the President of the United States to units of the Armed Forces of the United States and cobelligerent nations for extraordinary heroism in action against an armed enemy occurring on, or after, 16 Oct 41, for United States Navy and United States Marine Corps units, and on or after 7 Dec 41, for United States Army units. The unit must have displayed such gallantry, determination, and esprit de corps in accomplishing its mission under extremely difficult and hazardous conditions to have set it apart and above other units participating in the same campaign. The degree of heroism required is the same as that which would be required for award of a Distinguished Service Cross to an individual. After a thorough review of the applicant’s military personnel record, there was no documentation, nor was any provided by the applicant to verify he served with a unit that received award of the PUC. The AFAM was authorized by the Secretary of the Air Force on 12 Oct 80 and is awarded to members of the Armed Forces of the United States and foreign military personnel, below the rank of Colonel, after 30 Sep 81 who while serving in any capacity with the United States Air Force, distinguishes themselves by meritorious service or achievement. They were unable to locate a Special Order, certificate or recommendation to verify the applicant was recommended for or awarded the Air Force Achievement Medal. The Air Force Overseas Ribbon was authorized by Chief of Staff, United States Air Force, on 12 Oct 80. The ribbon was authorized to be awarded to Air Force and Air Force Reserve members credited with completion of an overseas tour on or after 1 Sep 80. Only individuals serving on active duty as of 6 Jan 86 are eligible to have the Air Force Overseas Ribbon applied retroactively for completion of an overseas tour. The applicant's dates of service from 7 Aug 62 to 5 Mar 69 are prior to the authorization date for award of the AFOST and the AFOLT. The applicant separated from active duty in 1969, rendering him ineligible for award of the AFOLT and AFOST ribbons. He was not on active duty as of 6 January 1986 to be eligible for the awards retroactively. Notwithstanding the above, AFPC/DPSID’s research verified award of the AFOUA, AFGCM, and the AFLSM. Upon final board decision, administrative correction of the applicant's official military personnel record reflecting award of the AFOUA and AFGCM will be completed by AFPC/DPSOR. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 1 Jun 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice with respect to the applicant’s request for the PUC w/1OLC, AFOST, -AFOLT, and AFAM. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force OPR and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. We note the Air Force OPR has verified the applicant’s entitlement to the AFGCM and AFOUA and will correct his records administratively. Additionally, it verified that the AFLSM was annotated on applicant’s DD Form 214, dated 5 Mar 69, no action required. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting any relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
