RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00286 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His Place of Birth (POB) be corrected. APPLICANT CONTENDS THAT: His POB is incorrectly reflected as Santa Cruz, CA rather than Santa Cruz, Bolivia. The applicant’s complete submission, with attachment, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of airman first class (E-3). According to Department of State Form FS-240, Consular Report of Birth Abroad (CRBA), the applicant was born at Santa Cruz, Bolivia. In a letter dated 1 July 2015, SAF/MRBR advised the applicant that AFI 36-2603, Air Force Board for Correction of Military Records, paragraph 4.7.3, requires that if an applicant has not exhausted all available effective administrative remedies, the application will be denied by the Board on that basis. SAF/MRBR invited the applicant to administratively close his case until such time that he is able to avail himself of the administrative avenues described in the attached AFPC/DPSIRP advisory opinion. As of this date, no response has been received by this office (Exhibit C). AIR FORCE EVALUATION: AFPC/DPSIRP recommends denial indicating that the applicant has not exhausted all available avenues of administrative relief prior to seeking correction of his military record before the Board. According to AFI 36-2608, Military Personnel Records System, a member on active duty requesting a correction to their POB will submit supporting documents to their Military Personnel Section (MPS) who will review, verify and update the Military Personnel Data System. This update will generate the appropriate documents to update the member’s master personnel records. The applicant did not follow the proper administrative process to correct his POB. A complete copy of the DPSIRP evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 31 July 2015, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit C). THE BOARD CONCLUDES THAT: 1. The applicant has not exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an injustice. We note the OPR states the applicant has not exhausted administrative avenues of relief and that this Board normally insists on exhaustion of subordinate administrative review before providing relief. However, in this case, the applicant has provided a certified copy of Department of State Form FS-240 which reflects that his place of birth is Santa Cruz, Bolivia. Being mindful of administrative economy, we recommend the applicant’s record be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that his place of birth be changed to Santa Cruz, Bolivia rather than Santa Cruz, California.
