RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. . IN THE MATTER OF: DOCKET NUMBER: BC-2015-00472 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be amended to reflect that he served in Vietnam, Cambodia and Thailand. APPLICANT CONTENDS THAT: Vietnam is not reflected on his DD Form 214. This error is preventing him from receiving Department of Veterans Affairs (DVA) benefits for his injuries due to Agent Orange exposure. His AF Form 7, Airman Military Record, reflects that he served in Mactan Isle, Philippines. In support of his request, the applicant provides copies of his DD Form 214, Temporary Duty (TDY) assignment orders, correspondence from the Air Force Historical Research Agency (AFHRA) and various other documents associated with his request. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant entered the Regular Air Force on 29 August 1962 and was released from active duty on 16 August 1966. AIR FORCE EVALUATION: AFPC/DPAPP recommends denial since the information provided and his master personnel records did not contain information that reflects he served in Vietnam, Cambodia or Thailand. DPAPP was able to verify and confirm foreign service boots on ground at Mactan Isle, Republic of the Philippines but unable to verify any foreign service in Vietnam, Cambodia or Thailand. ? A complete copy of the AFPC/DPAPP evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: According to the AFHRA, the entire 463d Field Maintenance Squadron (463 FMS), which he was assigned to, rotated through three bases to include Tan Son Nhut AB, Vietnam on a 11-day Temporary Duty (TDY) rotation. He provides a travel voucher from MacTan Isle to Clark AB, Philippines and return to Mactan Isle for travel performed on 27 March 1966. Although the travel voucher is not for a TDY assignment to Tan Son Nhut AB it shows he rotated from base to base during the rotation period and appropriate pages from the AFHRA unit history should be sufficient circumstantial evidence to show he was in Vietnam for at least one 11 day rotation. Additionally, he is specifically listed on Special Order A- 1735 dated 26 October 1965 which reassigned the 463d Troop Carrier from Langley AFB to MacTan Isle to provide support to the Army and Marines in Vietnam. The 463 FMS received many medals for being in Vietnam but he never received any. The applicant’s complete submission, with attachments, is at Exhibit E. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. The applicant’s complete submission was thoroughly reviewed and his contentions were duly noted. However, we do not find the documentation provided sufficiently persuasive to override the rationale provided by the Air Force Office of Primary Responsibility (OPR). Therefore, we agree with the opinion and recommendation of the OPR and adopt the rationale expressed as the basis for our conclusion the applicant has failed to sustain his burden of proof that he has been the victim of an error or injustice. Should the applicant provide evidence to substantiate he served in Vietnam, Cambodia or Thailand, we may be willing to reconsider his request. In view of the above and in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
