IN THE MATTER OF: DOCKET NUMBER: BC-2015-00602 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect the following awards: 1.  Cold War Medal Commemorative Medal 2.  Vietnam Service Medal (Administratively resolved) 3.  Presidential Unit Citation 4.  Republic of Vietnam Campaign Medal (Administratively resolved) 5.  American Defense Service Medal with Fleet Clasp 6.  Air Force Outstanding Unit Award (Administratively resolved) 7.  Air Force Longevity Service Award 8.  Overseas Service Commemorative Medal 9.  Vietnam Service Commendation Medal APPLICANT CONTENDS THAT: He earned all the requested awards, some of which were awarded post active service. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 23 Jun 66. On 3 Apr 70, the applicant was furnished an honorable discharge, and was credited with three years, nine months, and eleven days of active service, to include eleven months and twenty-seven days of foreign service. On 26 Feb 75, a DD Form 215 updating the applicant’s DD Form 214 was issued reflecting the award of the Vietnam Service Medal (VSM). On 3 Dec 04, a DD Form 215 updating the applicant’s DD Form 214 was issued reflecting the award of the Air Force Outstanding Unit Award with One Oak Leaf Cluster (AFOUA W/1OLC), and the Republic of Vietnam Campaign Medal (RVCM). The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. After a thorough review of the applicant's official military personnel record, they were unable to verify award of the Cold War Commemorative Medal, Presidential Unit Citation, American Defense Service Medal with Fleet Clasp, Air Force Longevity Service Award, Overseas Service Commemorative Medal, and Vietnam Service Commendation Medal. Specifically, regarding award of the Cold War Commemorative Medal, Overseas Service Commemorative Medal, and Vietnam Service Commendation Medal; these medals are not official awards or decorations of the United States Air Force and Department of Defense, however, the applicant may obtain them from a commercial source. There was no official documentation provided that verified any units the applicant was assigned to received the Presidential Unit Citation while he was assigned to the unit. The applicant’s active duty dates are from 23 Jun 66 to 3 Apr 70, for a total of 3 years, 9 months, and 11 days, making him ineligible for the Air Force Longevity Service Award which requires a completion of 4-years active duty service. Finally, the applicant entered active duty on 14 Jan 71, numerous years after the inclusive period (8 Sep 39 to 7 Dec 41) for award of the American Defense Service Medal with Fleet Clasp, rendering him ineligible. Notwithstanding the above, they were able to verify award of the AFOUA W/1OLC and the RVCM as annotated on the applicant's correction to DD Form 214 Certificate of Release or Discharge from Active Duty (DD Form 215) dated 2 Dec 04, and the Vietnam Service Medal (VSM) as annotated on the applicant's DD Form 215 dated 26 Feb 75. They were also able to determine that the Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P) should have been awarded during the applicant's service from 23 Jun 66 to 3 Apr 70 and was not reflected in his records. Upon final board decision, administrative correction adding the RVNGC w/P to the applicant's official military personnel record will be completed by AFPC/DPSOR. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 25 Sep 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The applicant was not timely filed. While the applicant claims a date of discovery of less than three years ago, in our view, the reasonable date of discovery of the alleged error or injustice was more than three years ago and the application is therefore untimely; however, it is in the interest of justice to excuse the failure to timely file. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the AFPC/DPSID and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice regarding award of the Cold War Commemorative Medal, Presidential Unit Citation, American Defense Service Medal with Fleet Clasp, Air Force Longevity Service Award, Overseas Service Commemorative Medal, and the Vietnam Service Commendation Medal. We note that AFPC/DPSID’s research did reveal that the Air Force Outstanding Unit Award with One Oak Leaf Cluster (AFOUA W/1OLC), Republic of Vietnam Campaign Medal (RVCM), and the Vietnam Service Medal (VSM) had previously been administratively resolved via corrections to DD Form 214 Certificate of Release or Discharge from Active Duty (DD Form 215). Additionally, they were able to determine that the Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P) should have been awarded during the applicant's service from 23 Jun 66 to 3 Apr 70 and was not reflected in his records. Upon final Board decision, they have directed AFPC/DPSOR to administratively correct the applicant’s military personnel record reflecting award of the RVNGC w/P. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting any relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
