RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-00754 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: She be placed on active duty orders for the purpose of Medical Continuation (MEDCON) for the period of 8 June 2011 to completion of her Medical Evaluation Board (MEB) on 26 June 2015. APPLICANT CONTENDS THAT: She was diagnosed with Post-traumatic Stress Disorder (PTSD) after her 2007 deployment to Iraq. She was kept on orders until 7 June 2010 and received Incapacitation Pay (INCAP) for the period of 8 June 2010 to 7 June 2011. However, she was denied MEDCON orders as required by DODI 1241.2, Reserve Component Incapacitation System Management. In support of her request, the applicant provides copies of her Line of Duty (LOD) determination dated 9 November 2010, AF Forms 469, Duty Limiting Condition Report; AFRC/SGP memorandum dated 2 August 2013 and other various documents associated with her request. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently on the Temporary Disability Retired List (TDRL) in the grade of Technical Sergeant (TSgt, E-6). The applicant was in the Air Force Reserve and entered a period of active duty service on 30 August 2006 and was released from active duty on 17 February 2007, with a narrative reason for separation of “Release due to Demobilization.” According to AFRC IMT 348, Informal Line of Duty Determination, dated 9 November 2010, the applicant’s diagnosis of PTSD was found in the LOD on 4 January 2011. Per Special Order ACD-02221 dated 2 June 2015, the applicant was placed on the TDRL in the grade of TSgt with compensable percentage for physical disability of 80 percent effective 27 June 2015. The remaining relevant facts pertaining to this application are described in the memorandum prepared by the Air Force Office of Primary Responsibility (OPR), which is included at Exhibit C. AIR FORCE EVALUATION: AFPC/DPFA recommends the applicant be placed on MEDCON orders from 8 June 2010 to 21 October 2010 and 8 July 2011 to 26 June 2015, the final Integrated Disability Evaluation System (IDES) processing date. Although it is the current observation of existing MEDCON cases that service members who have PTSD are normally kept on MEDCON once they meet eligibility criteria until they are finally processed through the IDES, the applicant has not provided medical documentation indicating she was treated for her PTSD during 2011 to 2012 [sic]. It is conceivable the applicant received mental health care through a civilian provider or the Veterans Affairs (VA) during this period; however, that documentation is not available for review at this time. Unless the applicant provides medical documentation indicating medical treatment for her PTSD, there is not a strong argument for continuous MEDCON. According to the August 2012, Secretary of the Air Force (SAF) MEDCON Policy Guidelines, paragraph 3, MEDCON eligibility requires a LOD determination and a finding by a credentialed military health care provider highlighting an unresolved health condition requiring treatment. It does appear valid to award the applicant retirement points from 8 June 2010 to 21 October 2010 as she would have met MEDCON eligibility during that time frame per the submitted documentation and she was receiving INCAP Pay at the time. A complete copy of the AFPC/DPFA evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: She received care from the Long Beach, CA VA from 2010 to 2011 and also received care from civilian providers. She was assigned a new doctor for her PTSD and it took more than six months to get in to see him. Since her diagnosis of PTSD, she has always tried to receive treatment for her condition. She provides evidence of her treatment for her PTSD. She requests full pay, entitlements and points for the entire period she would have been eligible for MEDCON orders. The applicant’s complete response, with attachments, is at Exhibit E. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant partial relief. We note the applicant requests continuous MEDCON orders for the period of 8 June 2011 to 26 June 2015; however, having carefully reviewed the applicant’s complete submission to include her rebuttal and the evidence of record, we agree with the opinion and recommendation of the Air Force OPR and adopt the rationale expressed as the basis for our conclusion that the applicant be placed on MEDCON orders for the periods of 8 June 2010 to 21 October 2010 and 8 July 2011 to 26 June 2015. We recognize the applicant received INCAP Pay for the period 8 June 2010 to 21 October 2010; however, as pointed out by the Air Force OPR, the documentation provided by the applicant supports granting MEDCON orders for this period. Accordingly, she should receive the associated pay and points authorized under MEDCON orders. Should the applicant submit additional medical documentation to show she was treated for her PTSD in 2010 to 2011 to warrant continuous MEDCON orders, we would be willing to reconsider her request. Therefore, we recommend the applicant’s records be corrected to the extent indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that she was placed on active duty, for the purpose of medical continuation, for the periods of 8 June 2010 to 21 October 2010 and 8 July 2011 to 26 June 2015, for the purpose of medical continuation in accordance with Title 10, U.S.C. § 12301(h).
