RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-00760 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be awarded the Meritorious Service Medal (MSM). APPLICANT CONTENDS THAT: He was told he was getting an Air Force Commendation Medal (AFCM) instead of an MSM due to Headquarters Military Airlift Command (HQ MAC) stating they had given out too many MSMs. He served his country proudly during his 26 years in the Air Force. Since retiring from his job as a veterans’ representative, he feels it is time to correct this error and receive the MSM that is due to him. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant retired on 31 August 1985 in the grade of Technical Sergeant (TSgt, E-6). AIR FORCE EVALUATION: AFPC/DPSID recommends denial of the applicant’s request for award of the MSM. There is no evidence in his record and the applicant did not present any to support award of the MSM or justify an error or injustice exists. In order to reasonably consider the applicant’s request, he needs to submit a recommendation for upgrade from someone with firsthand knowledge of the act/achievement preferably from someone within his chain of command at the time of the act/achievement, a proposed citation, and eyewitness statements. The applicant has not provided any documentation to substantiate he was promised award of the MSM. It is up to the discretion of those in the applicant’s direct chain of command at the time the act/achievement occurred as to what decoration is appropriate recognition upon the occasion of his retirement. To grant relief would be contrary to the criteria established by DODM 1348.33, Manual of Military Decorations and Awards, the Secretary of the Air Force and Chief of Staff. The applicant was awarded the AFCM per HQ MAC Special order G- 104 dated 14 April 1983 for meritorious service while assigned to the 60th Air Base Group, Travis AFB, CA for the inclusive period of 5 August 1979 to 10 February 1983. The MSM is awarded to any member of the United States Armed Forces or to any member of the Armed Forces of a friendly foreign nation, for outstanding non-combat meritorious achievement or outstanding non-combat meritorious service to the United States. Normally the acts or services rendered must be comparable to that required for the Legion of Merit but in a duty of less though considerable responsibility. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: In further support of his request, the applicant provides a copy of a citation for award of the MSM for the period 11 February 1983 to 31 August 1985. The applicant’s complete submission, with attachment, is at Exhibit E. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant award of the MSM. We took notice of the applicant’s complete submissions in judging the merits of this case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
