Her DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect award of the Kuwait Liberation Medal-Kuwait with one device (KLM-K w/1 device). 2. Her DD Form 214 be corrected to reflect award of the Southwest Asia Service Medal with one device (SWASM w/1 device). (Already annotated on the applicant’s DD Form 214.) APPLICANT CONTENDS THAT: She should be awarded a second KLM-K for her deployment to Southwest Asia, Saudi Arabia from 7 Jun 94 through Sep 94. She was left off the roster for medals due to racism and sexual harassment by four men in her chain of command. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: According to the applicant’s DD Form 214, on 10 Apr 85, the applicant entered the Regular Air Force. On 30 May 95, the applicant was honorably discharge, and credited with 10 years, 1 month, and 21 days of total active service. According to the applicant’s DD Form 215, Correction to DD Form 214, Certificate of Release or Discharge from Active Duty, dated 8 Apr 97, her records were corrected to include award of the KLM. According to the applicant’s DD Form 214, she was awarded the SWASM w/1 device. AIR FORCE EVALUATION: AFPC/DPSID recommends denial. There are no devices authorized for the KLM-K as only one award of the KLM-K is authorized, regardless of the number of deployments to the area of eligibility in direct support of a qualifying operation. Furthermore, the KLM-K is only authorized for deployments in direct support of Operation DESERT SHEILD/DESERT STORM between 2 Aug 90 and 31 Aug 93; Operation PROVIDE COMFORT is not a qualifying operation for which the KLM-K is authorized. The applicant's record correctly reflects award of the KLM-K without any devices. The KLM-K was authorized by the government of Kuwait to members of the U.S. military who participated in Operations DESERT SHIELD, DESERT STORM, and the liberation of Kuwait. On 16 Mar 95, Secretary of Defense authorized the acceptance and wear of the KLM-K by members of the Armed Forces of the United States. U.S. military personnel must have served in support of Operations DESERT SHIELD and DESERT STORM between 2 Aug 90 and 31 Aug 93, in the following areas: The Persian Gulf, the Red Sea, the Gulf of Oman, that portion of the Arabian Sea that lies north of 10 degrees North latitude and west of 68 degrees East longitude; the Gulf of Aden; or, the total land areas of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar, and the United Arab Emirates. There are no authorized devices for the KLM­K. According to the applicant's Joint Service Achievement Medal citation, he deployed from 11 Apr 91 to 13 Jun 91 in direct support of Operation PROVIDE COMFORT. The KLM-K is only authorized for deployments to the area of eligibility in direct support of Operation DESERT SHEILD/DESERT STORM. Previous verification of the Kuwait Liberation Medal­ Kuwait was made in 97 for the applicant's deployment to the area of eligibility in direct support of Operation DESERT SHEID/DESERT STORM. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant questions why she was not awarded two Southwest Asia Service Medals indicating she filed for these medals two years ago (Exhibit E). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant award of an additional KLM. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Additionally, we note the applicant request the SWASM w/1 device be added to her DD Form 214. However, this award is already annotated on the applicant’s DD Form 214. Therefore, we find no basis to recommend granting any of the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
