RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00778 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: She receive medical continuation (MEDCON) orders for the period 31 Dec 14 through 9 Feb 15. APPLICANT CONTENDS THAT: Her MEDCON orders were requested on 26 Nov 14 but due to delays in processing were not published until 9 Feb 15. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Air Force Reserve on 4 Jun 14. According to the documentation provided by the applicant: a.  Under Reserve Order #A684QU, dated 22 Jul 14, the applicant was ordered to deploy to Al Dhafra Air Base, United Arab Emirates, during the period 26 Sep 14 through 12 Jun 15. b.  On 13 Nov 14, the applicant fractured her left arm. c.  On 16 Nov 14, she was evacuated to her home station, and her deployment orders were curtailed as of 30 Nov 14. d.  On 3 Dec 14, MEDCON orders were requested and approved for the period 1 Dec through 30 Dec 14. e.  On 16 Jan 15, the applicant’s injuries were determined to be in the line of duty (ILOD). f.  Additional MEDCON orders for the applicant were eventually issued beginning on 10 Feb 15, creating a break in service from 31 Dec 14 through 9 Feb 15. The remaining relevant facts pertaining to this application are described in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is included at Exhibit C. AIR FORCE EVALUATION: AFPC/DPFA recommends granting the applicant’s request, indicating there is evidence of an error or injustice. MEDCON eligibility requires a Line of Duty (LOD) determination and a finding by a credentialed military health care provider that the Airman has an unresolved health condition requiring treatment (with active treatment plan) and renders the Airman unable to meet retention or mobility standards in accordance with (IAW) AFI 48-123, Medical Examinations and Standards. The Medical Case Manager validated the applicant was injured in the line of duty in Nov 14 and was subsequently medevac’d home, but the LOD was not signed off by the medical officer until 31 Dec 14, and by the applicant’s commander until 6 Jan 15. If the LOD had been processed according to the guidelines the applicant would have been eligible for MEDCON orders. The administrative delay in LOD processing was at no fault of the applicant and is the clear explanation of why her MEDCON orders did not begin until 10 Feb 15. Recommend correcting the applicant’s record by issuing her MEDCON orders covering the period 31 Dec 14 through 9 Feb 15. A complete copy of the AFPC/DPFA evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 26 Oct 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of AFPC/DPFA and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show she was not released from active duty on 31 December 2014, but on that date she was continued on active duty for the purpose of medical continuation through 9 February 2015.
