IN THE MATTER OF: DOCKET NUMBER: BC-2015-00851 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His unknown character of service for the period 25 Aug 03 through 22 Oct 04 with the Air Force Reserve (AFR) be characterized. APPLICANT CONTENDS THAT: He served in the AFR from 25 Aug 03 to 22 Oct 04. He was discharged from the AFR after being disenrolled from the Air Force Reserve Officer Training Corps (AFROTC). His Department of Veterans Affairs (DVA) military history reflects his service characterization for the period he served in the AFR as unknown. His records further reflect his rank while in the AFR was second lieutenant. He never received notification of being commissioned. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 15 Aug 03, the applicant commenced his enlistment in the AFR to attend AFROTC. On 22 Jul 04, the applicant was disenrolled from AFROTC for failure to maintain military retention standards and breach of AFROTC contract. The applicant failed to maintain retention standards when he failed the physical fitness test twice. He breached his AFROTC contract when he failed to maintain status as a full time student in the Fall 03 term. On 22 Jul 04, the applicant was furnished an honorable discharge in the rank of Airman First Class. AIR FORCE EVALUATION: ARPC/DPTT recommends denial indicating there is no evidence of an error or an injustice. The applicant was an AFROTC student and was entered into the military personnel database system (MilPDS) with the projected rank of second lieutenant. He was disenrolled for failure to graduate, and was discharged as an enlisted member since he was never commissioned. Service members are dropped from MilPDS upon completion of the discharge package and their disenrollment packages are forwarded to the National Personnel Records Center (NPRC). The Department of Defense (DoD) Military Service Information print out provided by the applicant, reflecting his DVA military history, is not a primary source document used to verify Reserve service. The applicant should contact the DVA to resolve any discrepancies in his DVA military history. The applicant’s time in AFROTC is non-creditable, and therefore, a DD Form 214, Certificate of Release or Discharge from Active Duty, was not issued. A complete copy of the ARPC/DPTT evaluation, with attachments, is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 11 Jun 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The applicant was not timely filed. While the applicant claims a date of discovery of less than three years ago, in our view, the reasonable date of discovery of the alleged error or injustice was more than three years ago and the application is therefore untimely. However, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
