RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01000 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His military records be corrected to show Post-9/11 GI Bill Transfer of Education Benefits (TEB) to his step-son. APPLICANT CONTENDS THAT: He was unjustly denied transfer of TEB entitlement due to misinformation from multiple agencies while on active duty and retired. He began terminal leave 14 Sep 12 and got married just following that on 24 Sep 12. In October 2012, he called the local base education office to inquire about transferring benefits to his step-son, but was told he did not have enough time to extend his service commitment. In January and September of 2013, he spoke with Department of Veteran’s Affairs (DVA) education and training personnel who informed him he could not transfer benefits. He also called the myPers Total Force Service Center (TFSC) in October 2014 and was told he could not transfer benefits due to his retirement. He was never told by any of the sources he contacted that there was a High Year Tenure (HYT) exception/option that would have allowed him to transfer his benefits while still serving on active duty. The applicant’s complete submission is at Exhibit A. STATEMENT OF FACTS: On 5 Dec 88, the applicant entered active duty in the Regular Air Force. According to AF Form 1411, Extension or Cancellation of Extensions of Enlistment in the Regular Air Force (REGAF)/Air Force Reserve (AF Reserve)/Air National Guard (ANG), dated 25 Jan 12, he extended his two year and one month enlistment for one month in order to retire the first day of the month after reaching HYT in January 2013. On 27 Feb 12, in a memorandum to the Force Support Squadron, the applicant acknowledged he had been advised to seek counseling regarding education benefits. According to DD Form 2648 Test, Preseparation Counseling Checklist For Active Component (AC), Active Guard Reserve (AGR, Active Reserve (AR), Full time Support (FTS), and Reserve Program Administrator (RPA) Service Members, dated 9 Apr 12, the applicant checked ‘NO’ in block 14(a), Education benefits (Post 9-11 GI Bill Chapter 33). On 1 Jan 13, the applicant was relieved from active duty and retired, effective 2 Jan 13. He was credited with 24 years and 27 days of active service. As the applicant was eligible for retirement prior to 1 Aug 09, he would not have incurred a commitment to provide additional service had he transferred his benefits on or after 1 Aug 09. AIR FORCE EVALUATION: AFPC/DPSIT recommends approval, indicating the applicant attempted to apply for TEB prior to retirement but was misinformed regarding his eligibility to transfer benefits to his dependent. In accordance with AFI 36-2306, Voluntary Education Program, Attachment 9, A9.18.1.4.1, additional service was not required for TEB approval given his Total Active Federal Military Service Date was 5 Dec 88. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 31 Jul 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that on December 31, 2012, he elected to transfer his Post-9/11 GI Bill Educational Benefits to his eligible dependents.
