IN THE MATTER OF: DOCKET NUMBER: BC-2015-01009 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect the following awards and decorations: 1.  South West Asia Service Medal with three bronze service stars (SWASM w/3BSS). (Administratively resolved) 2.  Humanitarian Service Medal (HSM). (Administratively resolved) 3.  Joint Meritorious Unit Award. 4.  Air Force Basic Military Training Honor Graduate Ribbon (USAF BMTHGR). (Administratively resolved) APPLICANT CONTENDS THAT: He was awarded the BMTHGR, but it is not reflected on his DD Form 214. Additionally, he served in support of Operation DESERT SHIELD/STORM and Operation PROVIDE COMFORT and was not properly awarded the recognition for that service. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 13 Sep 88. On 14 Sep 92, the applicant was furnished an honorable discharge, and was credited with four years, and two days of active service, including two years, and two days of foreign service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The information provided and master personnel records of the applicant did not contain documentation verifying award of the Joint Meritorious Unit Award. The Joint Meritorious Unit Award is awarded to units in recognition of exceptionally meritorious conduct in the performance of outstanding service. Qualifying achievements must be superior to that which is expected under one of the following conditions and should be operational in nature: during action in combat with an armed enemy of the United States, in a declared national emergency situation, under extraordinary circumstances that involve national interest. Notwithstanding the above, they were able to determine that the below Air Force Medals and/or Ribbons should have been awarded during the applicant's service from 13 Sep 88 to 14 Sep 92 and was not reflected in his records. Administrative correction of the applicant's official military personnel record will be completed by AFPC/DPSOR: • Southwest Asia Service Medal with three Bronze Service Stars (SWASM w/3BSS) • Humanitarian Service Medal (HSM) • Air Force Longevity Service Award (AFLSA) • United States Air Force Basic Military Training Honor Graduate Ribbon (USAF BMTHGR) A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 31 Aug 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was not timely filed. While the applicant claims a date of discovery of less than three years ago, in our view, the reasonable date of discovery of the alleged error or injustice was more than three years ago and the application is therefore untimely; however, it is in the interest of justice to excuse the failure to timely file. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the AFPC/DPSID and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice regarding award of the Joint Meritorious Unit Award. We note that AFPC/DPSID’s research revealed the Southwest Asia Service Medal with three Bronze Service Stars (SWASM w/3BSS), Humanitarian Service Medal (HSM), and United States Air Force Basic Military Training Honor Graduate Ribbon (USAF BMTHGR), should have been awarded during the applicant’s service from 13 Sep 88 to 14 Sep 92, but were not reflected in his records. Upon final Board decision, they have directed AFPC/DPSOR to administratively correct the applicant’s military personnel record reflecting these awards and decorations. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting any relief beyond that rendered administratively.
