RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-01032 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be amended to reflect the following awards and decorations: Iraq Campaign Medal (ICM), Global War on Terrorism Service Medal (GWOT-S) and the Small Arms Expert Marksmanship Ribbon (SAEMR). (Will be administratively corrected). Air Force Achievement Medal (AFAM) for the period of 28 February 1994 to 12 May 1995; Any other awards and decorations he may be authorized. APPLICANT CONTENDS THAT: He was deployed to Bagdad, Iraq from 10 July to 16 November 2003. In support of his requests, the applicant provides copies of his Contingency Exercise Deployment (CED) orders, AFAM certificate, AF Form 522, USAF Ground Weapons Training Data and DD Form 214 for the period of 10 March 2003 to 30 January 2004. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 5 August 1993, the applicant entered the Regular Air Force and on 12 May 1995, he was released from active duty after serving 1 year, 9 months and 8 days. ? On 10 March 2003, the applicant entered a period of active duty and on 30 January 2004 he was released due to demobilization. The applicant is currently in the Air Force Reserve in the grade of Technical Sergeant (TSgt, E-6). The AFAM is awarded to Air Force personnel for outstanding achievement or meritorious service rendered specifically on behalf of the Air Force. It may also be awarded for acts of courage lesser than for award of the Air Force Commendation Medal (AFCM). AIR FORCE EVALUATION: AFPC/DPSID recommends denial of the applicant’s request for award of the AFAM with inclusive period from 28 February 1994 to 12 May 1995. The special order is the official source document for verification of award decorations and no special order was provided or located within the applicant’s official military record. There are several inconsistencies with the citation, even though the decoration appears to have a signature. The “Given Under My Hand” is left justified when it should be centered on the citation with the date directly under it, “Executive Correspondence” is stamped across the top and “Do not write on this cover as it is intended for re-use return it with the file copies to originating office” is stamped across the bottom, the citation appears to be incomplete as it just ends and does not contain a closing sentence In Accordance With (IAW) AFI 36-2803, Air Force Awards and Decorations Program. Furthermore, the applicant served for 1 year, 9 months and 8 days before being released for miscellaneous/general reasons. It is unclear under what condition the applicant would have received this AFAM. DPSID notes the Air Reserve Personnel Center updated this document to the applicant’s official military personnel record; however, no special order was ever updated. To grant relief would be contrary to the criteria established by DODM 1348.33, Manual of Military Decorations and Awards, the Secretary of the Air Force and the Chief of Staff. DPSID was able to determine the applicant should have been awarded the AFAM for the inclusive period of 13 July 2003 to 15 November 2003, ICM w/1 BSS, GWOT-S and SAEMR w/1 BSS. Upon the Board’s final decision, AFPC/DPSOR will administratively correct the applicant’s records to reflect these awards. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 21 September 2015 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, aside from the administrative corrections for award of the AFAM for the inclusive period of 13 July 2003 to 15 November 2003, ICM w/1 BSS, GWOT-S and SAEMR w/1, we find no basis to recommend granting the additional requested relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
