APPLICANT CONTENDS THAT: He did not complete 4 years of active duty; however, he was medically retired 2 months before because of an illness that occurred while deployed in a combat zone The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 29 Nov 10, the applicant entered the Regular Air Force. On 28 May 14, a Physical Evaluation Board (PEB) found the applicant unfit because of a physical disability and recommended permanent retirement. On 5 Jun 14 the applicant agreed with the findings and waived his right to a formal hearing. On 7 Aug 14, according to information provided by the applicant he applied for the Transfer of Education Benefits program (TEB) and was advised he was not eligible on 12 Mar 15. On 28 Sep 14, the applicant was medically retired, was furnished an honorable discharge, and was credited with 3 years, 9 months, and 29 days of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSIT recommends denial indicating there is no evidence of an error or an injustice. To be eligible for the TEB program a member must meet program requirements IAW AFI 36-2306 Voluntary Education Program: At the time of approval of a member’s request to transfer GI-Bill entitlement any member of the Armed Forces (active duty and/or Selected Reserve) must have had at least 6 years of service on the date of election and agree to serve 4 additional years in the Air Force from the date of request, regardless of the number of months transferred, or have at least 10 years of service on the date of election, is precluded by Air Force policy, DoD policy or statute from committing to 4 additional years of service and agrees to serve for the maximum amount of time allowed by such policy or statute. The applicant’s Total Active Federal Military Service Date is 29 Nov 10, and he was medically retired on 28 Sep 14. He is not eligible for the TEB program because he did not have 6 years of service at the time of election and could obtain the 4 year Active Duty Service Commitment with application approval. A complete copy of the AFPC/DPSIT evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 11 Aug 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
