RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-01293 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect he was awarded the following awards: 1.  Presidential Unit Citation (PUC). 2.  Air Force Outstanding Unit Award with Valor and one Bronze Oak Leaf Cluster (AFOUA w/V and 1BOLC). (Administratively resolved) 3.  Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P). (Administratively resolved) 4.  Vietnam Campaign Medal (VCM). (Administratively resolved) APPLICANT CONTENDS THAT: He is entitled to the requested awards based on being assigned to the 3rd Security Police Squadron (SPS) and the 35th SPS in Vietnam from 4 Apr 70 to 4 Apr 71. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 11 Jun 68. On 14 Jul 81, the applicant was furnished an honorable discharge, and was credited with twelve years, thirteen months, and four days of active service, to include three years, six months, and 22 days of foreign service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice regarding award of the PUC. The PUC is awarded in the name of the President of the United States to units of the Armed Forces of the United States and cobelligerent nations for extraordinary heroism in action against an armed enemy occurring on, or after, 16 Oct 41, for United States Navy and United States Marine Corps units, and on or after 7 Dec 41, for United States Army units. The unit must have displayed such gallantry, determination, and esprit de corps in accomplishing its mission under extremely difficult and hazardous conditions to have set it apart and above other units participating in the same campaign. The degree of heroism required is the same as that which would be required for award of a Distinguished Service Cross to an individual. After a thorough review of the applicant’s military personnel record, there was no documentation, nor was any provided by the applicant to verify he served with a unit that received award of the PUC. Notwithstanding the above, AFPC/DPSID’s research revealed that the following Air Force Medals and/or Ribbons should have been awarded during the applicant’s service from 11 Jun 68 to 14 Jul 81: 1.  AFOUA w/V & 2BOLC. 2.  Vietnam Service Medal with one Silver Service Star (VSM w/1SSS). 3.  RVNGC w/P. 4.  VCM. Upon final board decision, administrative correction of the applicant's official military personnel record reflecting award of aforementioned awards will be completed by AFPC/DPSOR. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 31 Jul 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice regarding the applicant’s request that his DD Form 214 be corrected to reflect the award of the Presidential Unit Citation (PUC). We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of AFPC/DPSID and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice regarding the award of the PUC. We note that AFPC/DPSID’s research revealed the Air Force Outstanding Unit Award with Valor and two Bronze Oak Leaf Clusters (AFOUA w/V & 2BOLC), Vietnam Service Medal with one Silver Service Star (VSM w/1SSS), Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P), and Vietnam Campaign Medal (VCM), should have been awarded during the applicant’s service from 11 June 1968 to 14 July 1981, but were not reflected in his records. Upon final Board decision, AFPC/DPSID has directed AFPC/DPSOR to administratively correct the applicant’s military personnel record to reflect these awards and decorations. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting any relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
