IN THE MATTER OF: DOCKET NUMBER: BC-2015-01300 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His Social Security Number (SSN) on his DD Form 214, Certificate of Release or Discharge from Active Duty, be changed to reflect SSN XXX-XX-----. APPLICANT CONTENDS THAT: On 17 March 2014, he discovered his SSN is incorrect on his DD Form 214. The change is required to apply for Department of Veterans Affairs (DVA) benefits. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 24 March 1965, the applicant entered the Regular Air Force and was released from active duty on 8 October 1968. His DD Form 214 reflects SSN XXX-XX-----. Reserve Order CA-014871 dated 23 March 1971, reflects the applicant was honorably discharged from the Air Force Reserve under SSN XXX-XX-7788. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force Office of Primary Responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSIRP recommends denial. Although XXX-XX----- is the SSN the applicant wants reflected on his DD Form 214, the SSN XXX- XX----- is also listed throughout his master personnel records and he did not provide any evidence of the correct SSN. AFI 36-2608, Military Personnel Records System, Table A7.3., Note 5, states “Do not correct records of former members unless evidence proves the name used while serving with the Air Force was erroneously recorded. The applicant entered and served under the Air Force Service Number XXXXXX57 but was discharged under SSN XXX-XX----- as reflected on his DD Form 214. The SSN XXX-XX---- is also listed on several documents; however, the applicant provides no proof to which SSN is correct. A complete copy of the AFPC/DPSIRP evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: He provides copies of his SSN card and honorable discharge certificate dated 23 March 1971 which reflect SSN XXX-XX-7788. The applicant’s complete submission, with attachments, is at Exhibit E. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We note the applicant provides a copy of a SSN card dated 28 September 2015 and a discharge certificate from the Air Force Reserve dated 23 March 1971 in support of his request that the SSN on his DD Form 214 be corrected. However, we are not persuaded the SSN on his DD Form 214 issued in conjunction with his discharge on 8 October 1968 is in error. In this respect, we note the applicant’s records contain documents which list both SSNs and it is not possible to determine if the SSN on his DD Form 214 is erroneous. Moreover, although the applicant provides a SSN card dated 28 September 2015, there was no information provided on when the SSN number was issued. Therefore, we agree with the opinion and recommendation of the Air Force office of primary responsibility that the applicant has not sustained his burden of proof of an error or an injustice. However, should the applicant provide evidence, such as a letter from the Social Security Administration Office, to substantiate the SSN listed on his DD Form 214 was incorrect at the time of his active duty service; we would be willing to reconsider his request. In view of the above and in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
