IN THE MATTER OF: DOCKET NUMBER: BC-2015-01348 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her last name on her DD Form 214, Certificate of Release or Discharge from Active Duty, be changed. APPLICANT CONTENDS THAT: Her request for name change is based on her divorce decree dated 16 Jan 15. She needs the name change on her DD form 214 to change her name in the Defense Finance and Accounting System (DFAS) for retired pay and on her Veteran’s Administration disability. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 29 Nov 78, the applicant entered the Regular Air Force. On 31 Jan 95 the applicant was furnished an honorable discharge, and was credited with 16 years, 2 months, and 2 days of active service. On 15 Jan 15, according to information provided by the applicant, the applicant divorced and changed her last name. On 9 Mar 15, SAF/MRBR provided the applicant a copy of SAF/MR Memorandum dated 9 Mar 15 providing an advisory on requests for a name change sent to the AF Board for Correction of Military Records (Exhibit D). The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSOR recommends denial indicating that the applicant has not provided evidence that an error or injustice occurred when her DD Form 214 was published. When a name change is effective after the publication of a DD Form 214, applicants provide the benefit/entitlement or service agencies with the DD Form 214 as prepared and show legal documentation to explain a change (e.g., marriage certificates and/or divorce decrees). While supporting data systems for ‘retirees’ may reflect a name change to coincide with system oriented pay/benefits/entitlements (e.g., military ID cards); historical documents such as DD Form 214 do not change. On 12 May 15 the applicant was notified by AFPC/DPSIRP that her name was changed in the Personnel Data System and that DFAS was notified to accomplish the same in the pay system.(Exhibit G). A complete copy of the AFPC/DPSOR evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 Aug 15 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission, including her rebuttal response, in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. However, we note administrative action has been taken to change her name in the Personnel Data System and with the DFAS. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
